ORDINANCE NO. 961182

Confirming a Release and Confidentiality Agreement between The B.F. Goodrich Company, Black & Veatch, and the City of Kansas City, Missouri regarding the trickling filter media repair at the Blue River Wastewater Treatment Plant.

WHEREAS, the City contract with The B.F. Goodrich Company in July 1987 for the fabrication and installation of trickling filter media material in four trickling filters at the Blue River Wastewater Treatment Plant; and

WHEREAS, Black & Veatch participated in the original design and construction phase oversight as consulting engineers for City for this project; and

WHEREAS, The B.F. Goodrich Company, Black & Veatch and the City have been communicating with one another regarding problems resulting from the subsidence of the media within the filters; and

WHEREAS, the parties have agreed to repairs thereby resolving the problems; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Council hereby affirms a Release and Confidentiality Agreement between The B.F. Goodrich Company, Black & Veatch and the City of Kansas City, Missouri, regarding the trickling filter media repair at the Blue River Wastewater Treatment Plant whereby the parties shall share the cost of the repairs. A copy of said agreement is attached hereto and made a part hereof by reference.
