ORDINANCE NO. 070304

 

Declaring the area generally located on the south side of 39th Street about 1,000 feet east of Blue Ridge Cutoff as blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Clarion Hotel Urban Renewal Plan. (656-S)

WHEREAS, the area generally located on the south side of 39th Street about 1,000 feet eat of Blue Ridge Cutoff is (1) blighted by reason of the predominance of defective or inadequate street layout, insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, retards the provision of housing accommodations or constitutes an economic or social liability or a menace to the public health, safety, morals, or welfare in its present condition or (2) insanitary by reason of a predominance of buildings and improvements which, by reason of dilapidation, deterioration, age or obsolescence, inadequate provision for ventilation, light, air sanitation or open spaces, high density of population and overcrowding of buildings, overcrowding of land, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, is conducive to ill health, transmission of disease, infant mortality, juvenile delinquency and crime or constitutes an economic or social liability and is detrimental to the public health, safety, morals, or welfare; and

 

WHEREAS, on February 20, 2007, the City Plan Commission reviewed this matter and recommended (1) approval of the designation of the area as blighted or insanitary area and (2) approval of the Urban Renewal Plan; NOW, THEREFORE,

 

WHEREAS, on February 28, 2007, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, adopted a resolution recommending that the area be declared blighted or insanitary and recommending approval of an Urban Renewal Plan for the area; and

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds that the proposed urban renewal area identified as the Clarion Hotel Urban Renewal Area generally located on the south side of 39th Street about 1,000 feet east of Blue Ridge Cutoff, legally described as:

 

 All that part of Tract A, Royalview Plat, a subdivision of land in Kansas City, Jackson County, Missouri and all that part of the northeast quarter of the southwest quarter of Section 20, Township 49, Range 32, in said city, county and state, more particularly described as follows: Commencing at the northeast corner of the northeast quarter of said southwest quarter, thence north 86 degrees 47 minutes 02 seconds west, along the north line of the northeast quarter of said southwest quarter, a distance of 429.00 feet, to the northwest corner of said Royalview plat; thence south 21 degrees 33 minutes 19 seconds west, along the west line of said Royalview plat, a distance of 31.61 feet, to the northwest corner of said Tract A, being a point on the south right of way line of 39th street, as now established; and the point of beginning; thence south 86 degrees 47 minutes 02 seconds east, along said south right of way line, a distance of 438.93 feet; thence south 86 degrees 43 minutes 33 seconds east, continuing along said south right of way line, a distance of 639.92 feet, to the northeast corner of said Tract A; thence south 28 degrees 48 minutes 11 seconds west, along the east line of said Tract A, a distance of 825.50 feet, to the point on the northerly right of way line of Interstate Highway No. 70, as now established; thence north 59 degrees 21 minutes 56 seconds west, along said northerly right of way line, a distance of 88.56 feet; thence north 50 degrees 04 minutes 04 seconds west, continuing along said northerly right of way line, a distance of 187.25 feet; thence north 59 degrees 21 minutes 56 seconds west, continuing along said northerly right of way line, a distance of 333.09 feet; thence north 53 degrees 46 minutes 45 seconds west, continuing along said northerly right of way line, a distance of 324.37 feet; thence north 3 degrees 12 minutes 58 seconds east, a distance of 262.40 feet, to a point on the south right of way line of 39th Street; south 86 degrees 47 minutes 02 seconds east, along said south right of way line, a distance of 74.08 feet, to the point of beginning.

 

Also known as, Tract 1, Certificate of Survey, filed August 20, 1997, as Document No. I-1127908, in Book T-6, at Page 6.

 

is a blighted or insanitary area need of redevelopment or in need of rehabilitation and is appropriate for an urban renewal project by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, pursuant to Chapter 99, RSMo.

 

Section 2. That the Council finds that the Urban Renewal Plan is feasible and in conformity with the general plan for the development of the community as a whole.

 

Section 3. That the Clarion Hotel Urban Renewal Plan, a copy of which is on file in the office of the City Clerk with this ordinance and is hereby approved.
