ORDINANCE NO. 030906

 

Authorizing the purchase of property located near 27th and Vine for the 27th Street Viaduct over Vine Street Project No. 5391; authorizing acceptance of the deed to the property; and authorizing expenditure of $1,900.00.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to purchase property in the 27th and Vine area, Jackson County, from the Missouri Department of Transportation, for the 27th Street Viaduct over Vine Street project. The legal description of the property to be purchased is as follows:

 

All rights, title and interest in a tract of land located in the Southeast 1/4 Southwest 1/4 of Section 9, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, described as follows: Beginning at a point on the northwest corner of Lot 14, Block 2 of Sheppard Bardollars Addition; thence easterly, along the north line of said lot, to a point in the center of the vacated alley; thence South 02E1723.92 West, in the center of said vacated alley, a distance of 240.21 feet to the true point of Beginning; thence South 21E0039.08 East a distance of 273.17 feet to a point, said point is also a point on the northerly right of way line of 27th Street; thence North 87E2550.76 West, along said northerly right of way line, a distance of 108.05 feet to a point, said point is a point in the center of said vacated alley; thence North 02E1715.66 East, in the center of said vacated alley, a distance of 250.37 feet to the point of beginning; containing 13,526 square feet, more or less, of land.

 

Section 2. That the Director of Public Works is further authorized to accept the deed and expend up to the sum of $1,900.00 from funds previously appropriated to Account No. 01-309-089-7323 for the purchase of the above reference property.

 

Section 3. That the City Clerk is hereby directed to record a copy of this ordinance in the office of the Recorder of Deeds for Jackson County, Missouri, as evidence of the acceptance of the herein described property by the City for public use purposes.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
