Approving an amendment to a
previously approved preliminary plan in District GP-3/4 on a 7.4 acre tract of
land generally located on the west side of N.W. Prairie View Road, north of N.W.
Barry Road. (12650-GP-6)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
an amendment to a previously approved preliminary plan in District GP-3/4
(Regional Business/High-Density Residential) on a 7.4 acre tract of land
generally located on the west side of N.W. Prairie View Road, north of N.W.
Barry Road, and more specifically described as follows:
A tract of land in
the Northeast Quarter of Section 12, Township 51 North, Range 34 West,
including all of Lots 1, 2 and 3 and all of Tracts A, AA, BB, CC and DD, Block
1, Zona Rosa 3rd Plat, a subdivision of land, all being in Kansas City, Platte
County, Missouri described as follows: Beginning at the Southeast corner of Lot
1, Block 1, Zona Rosa 1st Plat, a subdivision of land in said Kansas City;
thence North 012118 East along the Easterly line of said Lot 1 and the
Westerly line of said Lot 1, Zona Rosa 3rd Plat, 190.93 feet; thence North
01015 East along the Westerly line of said Lot 1, said Tract DD, said Tract
CC, said Tract BB, said Lot 3, and the Northerly extension thereof, 974.90
feet; thence North 900000 East, 129.74 feet; thence North 600000 East,
44.24 feet to the Northerly extension of the Easterly line of said Lot 3, said
line also being the Northerly extension of the Westerly right of way line of NW
Prairie View Road as established by the plat of Zona Rosa 2nd Plat, a
subdivision of land in said Kansas City; thence South 300000 East along said
Northerly extension lines and along said Westerly right of way line and said
Easterly lot line, 118.77 feet; thence Southerly along said Westerly
right-of-way line and said Easterly lot line, along a curve to the right, being
tangent to the last described course, having a radius of 162.50 feet, a central
angle of 300000 and an arc distance of 85.08 feet; thence South 00000
West along said Westerly right-of-way line and along the Easterly line of said
Lot 3 and said Lot 2, 586.30 feet to the Southeast corner of said Lot 2; thence
North 900000: East, 86.10 feet; thence South 14752 East, 219.71 feet;
thence Southerly along a curve to the right having an initial tangent bearing
of South 35959 West, with a radius of 272.00 feet, a central angle of
174319 and an arc distance of 84.13 feet; thence South 231333 West, 50.45
feet; thence South 210837 East, 63.08 feet; thence North 894921 West,
150.79 feet; thence South 862504 West, 183.39 feet to the Point of
Beginning. Tract Contains 7.37 acres, more or less.
is hereby approved, subject to
the following conditions:
1. That the developer dedicate additional right of way by
general warranty deed for N.W. Prairie View Road as required by Development
Services prior to issuance of a certificate of occupancy for Building JJ or
Building KK, as shown on the approved development plan.
2. That the developer make improvements to N.W. Prairie View Road
as required by Development Services prior to issuance of a certificate of
occupancy for Building JJ or Building KK, as shown on the approved development
plan.
3. That the developer secure permits for the sidewalk
improvements along N.W. Prairie View Road at the time street improvement
permits are secured.
4. That the developer subordinate to the City all private
interest in the area of any right-of-way dedication as required by Development
Services, and that the developer be responsible for all costs associated with
subordination activities.
5. That the developer submit plans for grading, siltation,
and erosion control to Development Services for approval and permitting prior
to beginning any construction activities.
6. That the developer secure a land disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area equals one acre or more.
7. That the developer submit a final plan to the City Plan
Commission for approval, including detailed information on landscaping, signage
(including elevations), lighting (including a photometric study showing zero
footcandles at the property line and no direct illumination beyond the property
line) and building elevations.
A copy of said amendment is on
file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
