ORDINANCE NO. 140774

 

Rezoning a 1.4 acre tract of land generally located on the south side of Swope Parkway between Chestnut Avenue on the east and Montgall Avenue on the west, from District R-1.5 to District O-1. (11075-P-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0962, rezoning approximately a 1.4 acre tract of land generally located on the south side of Swope Parkway between Chestnut Avenue on the east and Montgall Avenue on the west, from District R-1.5 (Residential dash 1.5) to District O-1 (Office dash 1), said section to read as follows:

 

Section 88-20A0962. That an area legally described as:

Land in the City of Kansas City, Jackson County, Missouri, comprised of all of Lots 4 through 7 inclusive, and all of Lots 18 through 21 inclusive, and a portion of Lots 8 and 17, all in Block 6 of Warder Park, a subdivision in Kansas City, more particularly described as follows: Beginning at an iron bar (LS196MLS94) located at the southwest corner of Swope Parkway and Chestnut Avenue, and also being the northeast corner of Lot 4; thence proceeding southerly along the west line of Chestnut Avenue following the east lot lines of Lots 4 through 8 inclusive, South 02 degrees 24 minutes 12 seconds West, 224.31 feet along west line of Chestnut Avenue; thence North 87 degrees 25 minutes 00 seconds West, 276.27 feet to a point along the east line of Montgall Avenue; thence proceeding northerly along the east line of Montgall Avenue, also being the west lot lines of Lots 17 through 21, North 02 degrees 28 minutes 16 seconds East, 224.31 feet to a point at the southeast corner of Swope Parkway and Montgall Avenue, also being the northwest corner of Lot 21; thence proceeding easterly along the south line of Swope Parkway also being the north lot lines of Lots 21 and 4, South 87 degrees 25 minutes 00 seconds East, 276.00 feet to the point of beginning. Containing 1.422 acres, more or less.

 

is hereby rezoned from District R-1.5 (Residential dash 1.5) to District O-1 (Office dash 1), all as shown outlined on a map marked Section 88-20A0962, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof, subject to the following condition:

 

That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, prior to issuance of any Building Permit.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
