ORDINANCE NO. 990282
Approving an amendment to a previously approved
development plan in District GP-7 (Agricultural and Low Density Residential
Uses) on approximately a 50 acre tract of land generally located at 4214 N.W. Cookingham
Drive. (10426-GP-2)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved development plan in District GP-7 (Agricultural and Low
Density Residential Uses) on approximately a 50 acre tract of land generally
located at 4214 N.W. Cookingham Drive, and more specifically described as
follows:
PARCEL A: The Southwest
Quarter of the Southwest Quarter of the Southeast Quarter of Section 17,
Township 52, Range 33, in Platte County, Missouri. Containing 10.0 acres, more
or less.
PARCEL B: A tract of
land in the Southwest Quarter of Section 17, Township 52, Range 33, Platte
County, Missouri, being bounded and described as follows: Beginning at a point
on the north line of the Southwest Quarter of Section 17, said point being
1933.29 feet east of the northwest corner of the Southwest Quarter of said
Section 17; thence South 8959'45" East along the north line of said
Southwest Quarter, 644.43 feet to the northeast corner of said Southwest
Quarter; thence South 005'24" East along the east line of said Southwest
Quarter, 2650.27 feet to the southeast corner of said Southwest Quarter; North
8945'41" West along the south line of said Southwest Quarter, 653.30
feet; thence North 006'06" East 2647.59 feet to the point of beginning.
Containing 39.46 acres, more or less. Except that part on the south now being
used for highway right of way. Subject to any and all easements and restrictions
of record.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer extend sanitary sewers as required by the Department of Public
Works.
5. That
the developer provide for fire protection as required by the Fire Department.
6. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
7. That
the developer dedicate additional right of way for N.W. Cookingham Drive as
required by the Department of Public Works so as to provide a total of 50 feet
of right of way as measured from the centerline of N.W. Cookingham Drive.
8. That
the developer improve one-half of N.W. Cookingham Drive to primary arterial
street standards as required by the Department of Public Works, including
construction of curbs, gutters and sidewalks and installation of streetlights.
9. That
the developer secure the approval of the Missouri Department of Transportation
prior to working in any State right of way.
10. That
the developer comply with the Kansas City International Airport height zoning
restrictions and that the developer construct no structure in this area exceeding
those restrictions.
11. That
the developer grant an Aviation Noise Easement to the City as required by the
Aviation Department.
12. That
the developer obtain a floodplain certificate prior to the issuance of a
building permit.
13. That
the developer submit a final plan for each phase of the development to the City
Plan Commission for approval, including plans for landscaping, grading and
signage prior to the issuance of a building permit.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 990282, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
