COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 160413

 

Vacating approximately 750 linear feet of N. Flintlock Avenue south of N.E. Cookingham Drive and directing the City Clerk to record certain documents. (1722-V)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council of Kansas City does hereby find and declare that on the 18th day of May, 2016, a petition was filed with the City Clerk of Kansas City by Lutjen for the vacation of a portion of N.E. Flintlock Road being approximately 782 feet in length and situated in the Southeast Quarter and Southwest Quarter of Section 35, Township 52 North, Range 32 West of the 5th Principal Meridian in Kansas City, Clay County, Missouri, from a point on the North line of previously vacated N.E. Flintlock Road by Kansas City, Missouri Ordinance No. 981279 and recorded April 16, 1999, in Book 2989, at Page 491, said point being 1673 feet North of the southeast corner of said Southwest Quarter, thence northerly approximately 782 feet to a point on a easterly extension of the southerly line of Little Shoal Baptist Church, now known as Little Shoal Cemetery, in Book 46, Page 451, said point also being 181.51 feet south of the north line of said Southeast Quarter, and all utility easements over, under, along and across said street, all in said Kansas City, Clay County, Missouri, giving the distinct description of the street to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said street has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 


Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That the Council finds that no private rights will be unreasonably injured or endangered by this vacation and that the public will suffer no unreasonable loss or inconvenience thereby.

 

Section 4. That a portion of N.E. Flintlock Road being approximately 782 feet in length and situated in the Southeast Quarter and Southwest Quarter of Section 35, Township 52 North, Range 32 West of the 5th Principal Meridian in Kansas City, Clay County, Missouri, from a point on the North line of previously vacated N.E. Flintlock Road by Kansas City, Missouri Ordinance No. 981279 and recorded April 16, 1999, in Book 2989, at Page 491, said point being 1673 feet North of the southeast corner of said Southwest Quarter, thence northerly approximately 782 feet to a point on a easterly extension of the southerly line of Little Shoal Baptist Church, now known as Little Shoal Cemetery, in Book 46, Page 451, said point also being 181.51 feet south of the north line of said Southeast Quarter, and all utility easements over, under, along and across said street, all in said Kansas City, Clay County, Missouri, be and the same is hereby vacated. That this vacation is conditioned on the following requirement: That a hammerhead turn-around be constructed prior to the issuance of any certificates of occupancy for the next phase of The Hills of Montclair.

 

Section 5. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Clay County, Missouri.

 

Section 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
