ORDINANCE NO. 000712

 

Accepting two Special Warranty Deeds from Property Reserve, Inc., of the County of Salt Lake and State of Utah, and accepting one Special Warranty Deed from Hunt Midwest Real Estate Development, Inc., conveying to the City of Kansas City, Missouri, certain property in Clay County, Missouri, all for public use as an addition to Hodge Park and directing the City Clerk to file same.

 

WHEREAS, the Council finds and determines that by Resolution No. 25035 adopted by the Board of Parks and Recreation Commissioners on March 21, 2000, certain lands were acquired through donation and purchase for public use for park purposes as an addition to Hodge Park in Kansas City, Clay County, Missouri, and said Board has now recommended to the Council that the deeds hereinafter described be accepted for public use; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the following listed deeds recorded in the office of the Director of Records for Clay County, Missouri, at Liberty, under the instrument numbers and in the books and pages indicated the Council hereby devotes the properties and said properties are hereby accepted for public use for park purposes in accordance with Article III, Section 58 of the Charter:

TRACT B: All that part of the South Half of Section 3, Township 51, Range 32, in Kansas City, Clay County, Missouri, being more particularly described as follows: Commencing at the northeast corner of the Southwest Quarter of said Section 3; thence North 88E01'7" West along the north line of said Southwest Quarter, a distance of 80.62 feet to the point of beginning of the tract of land to be herein described; thence South 17E39'22" East along the centerline of an existing Kansas City Power & Light Company easement recorded as Document No. C-16524 in Book 957 at page 316, a distance of 1129.03 feet; thence North 86E43'09" West, a distance of 1311.62 feet to a point on a jog in the east right of way line of Shoal Creek Parkway, as now established; thence North 0E57'11" East along the east right of way line of said Shoal Creek Parkway, a distance of 125.22 feet to the north end of said Shoal Creek Parkway right of way; thence North 0E42'11" East, 908.64 feet to a point on the north line of the Southwest Quarter of said Section 3; thence South 88E01'07" East along said north line, a distance of 954.38 feet to the point of beginning.

Section 2. That Resolution No. 25035 evidences the intent of the Board of Parks and Recreation Commissioners to accept such real property for park purposes.

 

Section 3. That the City Clerk is hereby directed to file a copy of this ordinance with the Office of the Director of Records for Clay County, Missouri, as evidence of the acceptance of the herein described property by the City for public use purposes.
