COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 021302

Approving the Fifteenth Amendment to the Development Plan submitted by the Crown Center Redevelopment Corporation and authorizing the Director of Finance to enter into a Sixteenth Supplemental Contract with the Crown Center Redevelopment Corporation.

WHEREAS, the Crown Center Redevelopment Corporation, an urban redevelopment corporation organized under and pursuant to the Urban Redevelopment Corporations Act of 1945, as amended, did on January 4, 1967, file with the City Clerk an application for approval of a Development Plan which was approved by the City Council by Ordinance No. 33763, passed March 31, 1967, said ordinance also authorizing a contract between the City and Crown Center Redevelopment Corporation; and

WHEREAS, said Development Plan was amended by Ordinance No. 35766, passed September 13, 1968; by Ordinance No. 39268, passed February 26, 1971; by Ordinance No. 44963, passed January 31, 1975; by Ordinance No. 45162, passed March 27, 1975; by Ordinance No. 48630, passed December 29, 1977; by Ordinance No. 50254, passed April 12, 1979; by Ordinance No. 55172, passed May 27, 1983; by Committee Substitute for Ordinance No. 55945, passed January 6, 1984; by Ordinance No. 58625, passed October 31, 1985; by Ordinance No. 61184, passed July 2, 1987; by Ordinance No. 63118, passed October 13, 1988; by Ordinance No. 980990, passed August 20, 1998; by Ordinance No. 991159, passed September 9, 1999; and by Ordinance No. 001615, passed April 4, 2001; and

WHEREAS, said contract was amended by Ordinance No. 35766, passed September 13, 1968; by Ordinance No. 38705, passed September 11, 1970; by Ordinance No. 39268, passed February 26, 1971; by Ordinance No. 44963, passed January 31, 1975; by Ordinance No. 45162, passed March 27, 1975; by Ordinance No. 48630, passed December 29, 1977; by Ordinance No. 50254, passed April 12, 1979; by Ordinance No. 55172, passed May 27, 1983; by Committee Substitute for Ordinance No. 55945, passed January 6, 1984; by Ordinance No. 58625, passed October 31, 1985; by Ordinance No. 61184, passed July 2, 1987; by Ordinance No. 63118, passed October 13, 1988; by Ordinance No. 980990, passed August 20, 1998; by Ordinance No. 991159, passed September 9, 1999; and by Ordinance No. 001615, passed April 4, 2001; and

WHEREAS, Ordinance No. 38705, passed September 11, 1970, did not amend the Development Plan but only authorized the Director of Finance to enter into a supplemental contract; and

WHEREAS, the Crown Center Redevelopment Corporation did on March 18, 2002, and revised on October 16, 2002, file with the City Clerk an application for an amendment to the Development Plan; and

WHEREAS, the City Clerk did refer said application for an amendment to the Development Plan to the City Plan Commission; and

WHEREAS, the City Plan Commission did cause to be published in The Pulse, a newspaper doing the City's printing, on July 1, 2002, that date being not less than ten days prior to the date set for the hearing, notice of the public hearing on said amendment to the Development Plan; and

WHEREAS, said City Plan Commission did hold a public hearing on said amendment to the Development Plan on August 20, 2002; and

WHEREAS, at the public hearing conducted by the City Plan Commission, all interested parties were given an opportunity to be heard at said public hearing; and

WHEREAS, the City Plan Commission has made an independent study and investigation of the proposed Fifteenth Amendment to the Development Plan and did, on August 20, 2002, did recommend approval of the proposed Fifteenth Amendment to the Development Plan, and said City Plan Commission has filed with the City Clerk a report recommending approval of said proposed amendment to the Development Plan, said report being attached hereto as Exhibit A and incorporated herein by reference; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Application of Crown Center Redevelopment Corporation for approval of the Fifteenth Amendment to its Development Plan, including all exhibits incorporated therein and filed with the City Clerk on March 18, 2002, and revised on October 16, 2002, as further revised, is hereby incorporated herein by reference and approved as the Fifteenth Amendment to the Development Plan as originally approved by Ordinance No. 33763, passed March 31, 1967; and as amended by Ordinance No. 35766, passed September 13, 1968; by Ordinance No. 39268, passed February 26, 1971; by Ordinance No. 44963, passed January 31, 1975; by Ordinance No. 45162, passed March 27, 1975; by Ordinance No. 48630, passed December 29, 1977; by Ordinance No. 50254, passed April 12, 1979; by Ordinance No. 55172, passed May 27, 1983; by Committee Substitute for Ordinance No. 55945, passed January 6, 1984; by Ordinance No. 58625, passed October 31, 1985; by Ordinance No. 61184, passed July 2, 1987; by Ordinance No. 63118, passed October 13, 1988; by Ordinance No. 980990, passed August 20, 1998; by Ordinance No. 991159, passed September 9, 1999, and by Ordinance No. 001615, passed April 4, 2002. A copy of the application and exhibits are on file in the office of the City Clerk under Document No. 021302, which is attached hereto and incorporated herein by reference.

Section 2. That the Council hereby finds and declares that good cause has been shown for the approval of said Fifteenth Amendment to the Development Plan of Crown Center Redevelopment Corporation and that the findings and declarations made by the Council in Section 2 of Ordinance No. 33763, with respect to the Development Plan of Crown Center Redevelopment Corporation, have not been affected by the amendments thereto and equally apply to said Development Plan, as amended.

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

Section 4. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a Sixteenth Supplemental Contract with the Crown Center Redevelopment Corporation, a copy of which is attached hereto as Exhibit B and which is hereby incorporated herein by reference.
