ORDINANCE NO. 140074

 

Amending the 2012 One Year Action Plan and authorizing submittal of a Substantial Amendment to the U.S. Department of Housing and Community Development for its consideration to permit a new activity to be funded and amend the budget for the further development of the Monarch Manor project; appropriating $150,000.00 in the HOME Investment Fund; estimating revenue in the amount of $150,000.00 in the HOME Investment Fund; authorizing the Director of Neighborhoods and Housing Services to execute a contract with Entrepreneurs Enterprises, LLC in an amount not to exceed $300,000.00 for costs associated with Monarch Manor Project; and designating requisitioning authority.

 

WHEREAS, on March 8, 2012, City Council passed Committee Substitute for Resolution No. 120159 which approved the 2012-2016 Consolidated Five Year Plan and the revised 2012 One Year Action Plan; and

 

WHEREAS, the Five Year Consolidated Plan (“Plan”) identified seven target areas which include: the Heart of the City, Greater Downtown, Swope, Midtown/Plaza, Hickman Mills/Ruskin, Briarcliff/Winnwood and Truman Plaza and the Plan further identified specific sub-target areas in which single family housing development and minor home repair services are to be implemented; and

 

WHEREAS, one of those sub-target areas is Monarch Manor located generally at 22nd Street and Garfield; and

 

WHEREAS, a request for proposals was issued seeking qualified real estate developers to carry out the development activity identified in the Five Year Consolidated Plan and subsequent Neighborhood Action Plans; and

 

WHEREAS, Entrepreneurs Enterprises, LLC was selected to acquire three parcels of property and construct three new houses in Monarch Manor to establish a market and encourage further development; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Substantial Amendment to the 2012 One-Year Action Plan, prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which in substantial form is attached hereto, is hereby approved.

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized to execute and submit the aforesaid Substantial Amendment to the United States Department of Housing and Urban Development.


Section 3. That the additional revenue in the amount of $150,000.00 is estimated in the HOME Investment Fund in the following account in the HOME Investment Fund:

 

14-2940-550001-476050-G55HOME12 HUD Grants $150,000.00

Section 4. That $150,000.00 is appropriated from Unappropriated Fund Balance of the HOME Investment Fund to the following account of the HOME Investment Fund:

14-2940-555311-B-G55HOME12 Neighborhood Revitalization $150,000.00

Section 5. That the Director of Neighborhoods and Housing Services is hereby authorized to execute a $300,000.00 contract with Entrepreneurs Enterprises, LLC for the costs associated with Monarch Manor development. A copy of the contract, in substantial form, is on file in the office of the Director of Neighborhoods and Housing Services and incorporated herein by reference.

 Section 6. That the Director of Neighborhoods and Housing Services is designated requisitioning authority for Account No. 14-2940-555311.

Section 7. That the City Council hereby certifies that said Substantial Amendment has been prepared and will be submitted to the U.S. Department of Housing and Urban Development pursuant to and in accordance with the Department’s rules and regulations, including but not limited to Title 24 Section 570.301 through and including Section 570.306 of the Code of Federal Regulations.

  I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
