ORDINANCE NO. 011086

Approving the First Amendment to the Development Plan submitted by the 12th and Grand Redevelopment Corporation on a tract of land of approximately 0.97 acres generally located at the northeast corner of 12th Street and Grand Avenue (1125 Grand Avenue); and authorizing execution of a First Amended Contract with the 12th and Grand Redevelopment Corporation.

WHEREAS, 12th and Grand Redevelopment Corporation, an urban redevelopment corporation organized under and pursuant to the Urban Redevelopment Corporations Law and amendments thereto, did on August 11, 1997, file with the City Clerk an application for approval of a Development Plan which was approved by the City Council by Ordinance No. 971696, passed February 12, 1998; and

WHEREAS, 12th and Grand Redevelopment Corporation did file with the City Clerk an application for a First Amendment to the Development Plan on March 27, 2001, revised on May 15, 2001; and

WHEREAS, the City Plan Commission did cause to be published in The Pulse, a newspaper doing the City's printing, on April 30, 2001, that date being not less than ten days prior to the date set for the hearing, notice of the public hearing on the First Amendment to the Development Plan; and

WHEREAS, said City Plan Commission did hold a public hearing on the First Amendment to the Development Plan on May 15, 2001; and

WHEREAS, at the public hearing conducted by the City Plan Commission, all interested parties were given an opportunity to be heard at said public hearing; and

WHEREAS, the City Plan Commission has made a study and investigation of the proposed First Amendment to the Development Plan and did, on May 15, 2001, recommend approval of the First Amendment to the Development Plan and did submit a report of the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the application of the 12th and Grand Redevelopment Corporation for approval of a First Amendment to the Development Plan, including all exhibits incorporated therein, is hereby incorporated by reference and approved as a First Amendment to the Development Plan as originally approved by Ordinance No. 971696, passed February 12, 1998. A copy of the application and exhibits are on file in the office of the City Clerk under Document No. 011086, which is attached hereto and incorporated herein by reference.

Section 2. That the Council hereby finds and declares that good cause has been shown for the approval of the First Amendment to the Development Plan of the 12th and Grand Redevelopment Corporation and that the findings and declarations made by the Council in Sections 2 and 4 of Ordinance No. 971696 with respect to the Development Plan have not been affected by the amendments thereto and equally apply to said Development Plan, as amended.

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

Section 4. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a First Amended Contract with the 12th and Grand Redevelopment Corporation, a copy of which, in substantial form, is attached hereto as Exhibit B and is hereby approved.
