ORDINANCE NO. 010127

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0341, rezoning an area of approximately 39.7 acres generally located on the north side of N.E. 72nd Street, east of the easterly Gladstone city limits from District RA (Agricultural) to District R-2b (Two-Family Dwellings). BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0341, rezoning an area of approximately 39.7 acres generally located on the north side of N.E. 72nd Street, east of the easterly Gladstone city limits from District RA (Agricultural) to District R-2b (Two-Family Dwellings), said section to read as follows:

 

Section 80-11A0341. That an area legally described as:

 

All that part of the Southwest Quarter of Section 17, Township 51, Range 32, Kansas City, Clay County, Missouri, lying north of N.E. 72nd Street and south of the centerline of Shoal Creek, being bounded and described as follows: Beginning at the southwest corner of said Southwest Quarter; thence North 0E44'01" East (deed - North 0E42'47" East), along the west line of said Southwest Quarter, 1033.28 feet to a point 1603.86 feet south of the northwest corner of said Southwest Quarter, said point being on the centerline of said Shoal Creek; thence South 63E05'28" East (deed - South 67E54'32" East), along said centerline, 373.49 feet (deed - 359.95 feet); thence North 80E11'14" East (deed - North 80E10'00" East), along said centerline, 140.00 feet; thence North 64E26'14" East (deed - North 64E25'00" East), along said centerline, 200.00 feet; thence North 48E30'02" East (deed - North 49E00'13" East), along said centerline, 366.34 feet (deed - 363.48 feet) to a point 1230.43 feet north of the south line and 923.37 feet east of the west line of said Southwest Quarter, said point being the beginning of a property line agreement described in Book 809 at page 360 of the office of the Recorder of Deeds in Clay County, Missouri; thence North 29E49'51" West (deed - North 30E847'30" West) along said line, 536.08 feet (deed - 537.03 feet), to a point that is 1691.60 feet north of the south line and 650.77 feet east of the west line of said Southwest Quarter; thence north along said line, said line being also the centerline of the Old Channel of Shoal Creek (per agreement), North 59E48'07" East (deed - North 59E46'54" East), along said line, 228.87 feet; thence South 53E48'46" East (deed - South 54E800'00" East), along said line, 131.00 feet; thence North 69E13'14" East (deed - North 69E12'00" East) along said line 138.00 feet; thence South 71E32'46" East (deed - 71E34'00" East), along said line 47.40 feet; thence South 2E06'14" West (deed - South 2E05'00" West), along said line, 110.10 feet; thence North 64E47'14" East (deed - North 64E46'00" East), along said line, 96.20 feet; thence South 63E11'59" East (deed - South 66E48'00" East), along said line, 106.18 feet (deed - 117.00 feet), to a point on the east line of said west one half; thence South 0E33'41" West (deed - South 0E40'04" West), along said east line,


780.99 feet; thence South 89E10'38" East, 181.33 feet; thence South 0E49'22" West, 325.00 feet; thence North 89E10'38" West, 129.85 feet; thence South 0E33'41" West, 550.00 feet to a point on the south line of the Quarter Section; thence North 89E10'38" West, along said south line, 1361.53 feet more or less to the point of beginning. Except that part in 72nd Street. Containing 39.7 acres.

 

is hereby rezoned from District RA (Agricultural) to District R-2b (Two-Family Dwellings), all as shown outlined on a map marked Section 80-11A0341, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the Zoning Ordinance.
