ORDINANCE NO. 180463

 

Authorizing the Director of General Services to execute a five-year lease agreement with two five-year options for renewal with SAVE, Inc., a Missouri Nonprofit Corporation, for the purpose of parking at 3116 Campbell Street, and portions of City owned lots on either side of the abutting alley.

 

WHEREAS, the City owns and needs to retain for ongoing maintenance and operation of existing utilities certain property commonly known as 3116 Campbell Street, and portions of City owned lots on either side of a north/south alley lying between Harrison Street and Campbell Street, and north of East Linwood Boulevard;

 

WHEREAS, two Missouri nonprofit corporations have each expressed an interest in making use of the City owned property for parking purposes for their nearby operations, being SAVE, Inc. (“SAVE”), and The Foundation for Delta Education and Economic Development (“DEED”);

 

WHEREAS, the City desires to make available such property for parking purposes, provided that SAVE and DEED collaborate and share such parking, but with the primary lease being held by SAVE which will bear the expense of refurbishment and replacement of the parking surface and all future maintenance and operational costs of such parking; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of General Services Department is authorized to further negotiate and execute a ground lease agreement with SAVE, Inc., for the City owned property commonly known as 3116 Campbell Street, and portions of City owned lots on either side of a north/south alley lying between Harrison Street and Campbell Street, and north of East Linwood Boulevard for the purpose of parking beginning the effective date of this Ordinance and ending June 30, 2023 with two five-year options for renewal, for the property set forth in Section 2 below, substantially in the form of the Exhibit A attached hereto, with the final signed form of the Ground Lease to be maintained on file with the Department of General Services (“Ground Lease”), but on the conditions that 1) any such Ground Lease will acknowledge that the Foundation for Delta Education and Economic Development, will be allowed to collaboratively use the parking on the leased premises in conjunction with their facilities at 900 East Linwood Boulevard, 2) the north/south alley lying between Harrison Street and Campbell Street, and north of East Linwood Boulevard shall remain open and accessible by and for the public, including the other property owners or occupants on either side of such alley and 3) the City shall have the right to terminate all or any portion of the Ground Lease for the purpose of the maintenance and operation of the utilities located thereunder.

Section 2. The Ground Lease will be for the following described lots or portions of lots:

Lots 13 & 14, Block 2, Troost Avenue Park, a subdivision of Kansas City, Jackson County, Missouri, commonly known as 3116 Campbell Street

 

West 20 feet of Lots 9, 10, 11, and 12, Block 2, Troost Avenue Park, a subdivision of Kansas City, Jackson County, Missouri, being on the east side of the north/south alley lying between Harrison Street and Campbell Street, north of East Linwood Boulevard; and

 

East 40 feet of Lot 15, and the East 40 feet of the North 8 1/3 feet of Lot 16, Block 2, Troost Avenue Park, a subdivision of Kansas City, Jackson County, Missouri being on the west side of the north/south alley lying between Harrison Street and Campbell Street, north of East Linwood Boulevard.
