COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 000337
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0273,
rezoning an area of approximately 4.7 acres generally located at the southwest
corner of 87th Street and I-435 from Districts R-1a (One-Family Dwellings) and
M-1-p (Light Industry - Limited District) to District M-1-p (Light Industry -
Limited District), and approving a preliminary plan for the same. (6743-P-7)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0273, rezoning an area of
approximately 4.7 acres generally located at the southwest corner of 87th
Street and I-435 from Districts R-1a (One-Family Dwellings) and M-1-p (Light
Industry - Limited District) to District M-1-p (Light Industry - Limited
District), said section to read as follows:
Section
80-11A0273. That an area legally described as:
TRACT B: All that part of the Southeast Quarter
of Section 23, Township 48, Range 33, in Kansas City, Jackson County, Missouri,
described as follows: Commencing at the northeast corner of said Southeast
Quarter; thence South 0E46' East, along the east
line of said Southeast Quarter, 230 feet; thence west, parallel to the north
line of said Quarter Section, 30 feet to the true point of beginning; thence
continuing west, parallel to said north line, 150 feet; thence south 0E46' East parallel to the east line of
said Quarter Section, 80 feet to a point 310 feet south of the north line of
said Quarter Section; thence east, parallel to the north line of said Quarter
Section, 150 feet; thence North 0E46'
West, parallel to the east line of said Quarter 80 feet to the point of
beginning.
TRACT A: All that part of the Southeast Quarter
of Section 23, Township 48, Range 33, in Kansas City, Jackson County, Missouri,
described as follows: Commencing at the northeast corner of said Southeast
Quarter; thence west, along the north line of said Quarter Section, 702.58
feet; thence South 0E46' East, parallel to
the east line of said Southeast Quarter, 310 feet to the true point of
beginning; thence commencing South 0E45'
East, parallel to said east line, 310 feet; thence east, parallel to the north
line of said Southeast Quarter, 545.93 feet to the westerly right of way line
of Hillcrest Road; thence North 27E40'
East, along the westerly right of way line of Hillcrest Road, 265.38 feet;
thence north, parallel to the east line of said Southeast Quarter, 76.63 feet;
thence west, parallel to the north line of said Southeast Quarter, 672.58 feet
to the point of beginning.
is
hereby rezoned from Districts R-1a (One-Family Dwellings) and M-1-p (Light
Industry - Limited District) to District M-1-p (Light Industry - Limited
District), all as shown outlined on a map marked Section 80-11A0273, which is
attached hereto and made a part hereof, and which is hereby adopted
as a part of an amendment to
the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That
a preliminary plan for the area legally described above is hereby approved,
subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any improvements as required by the City
Engineer's Office.
3. That
the developer submit plans for grading, and siltation and erosion control to
the City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer dedicate additional right of way on the west side of Hillcrest
Road as required by the Department of Public Works so as to provide 30 feet of
right of way as measured from the centerline of Hillcrest Road.
7. That
the developer improve the west half of Hillcrest Drive to collector street
standards as required by the Department of Public Works.
8. That
the developer provide additional fire hydrants to serve the existing structures
as required by the Fire Department.
9. That
the developer secure the approval of the Missouri Department of Transportation
prior to working in any State right of way.
10. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for signage, grading, and landscaping.
A
copy of said preliminary plan is on file in the office of the City Clerk under
Document No. 000337, which is attached hereto and made a part hereof.
Section
C. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
