RESOLUTION NO. 020910

 

Approving an amendment to the Westport Planning Area Plan, being that part of Kansas City bounded by the 31st Street Trafficway, State Line Road, Ward Parkway and Troost Avenue, by modifying the Land Use Plan and Map for an area generally bounded by Linwood Boulevard on the north, 33rd Street on the south, Troost Avenue on the east and Campbell Street on the west, to recommend mixed use (commercial and residential instead of multi-family residential, low density, multi-family residential, medium density and retail and an area generally bounded by 33rd Street on the north, 39th Street on the south, Troost Avenue on the east and the eastern one-half block of the area between Harrison Street and Troost Avenue, to recommend residential (mixed densities), mixed use (commercial and residential) and public/semi-public/institutional instead of multi-family residential, medium density, retail and public and semi-public uses. WHEREAS, on August 11, 1972, the City Council through the adoption of Resolution No. 41438 which adopted the Westport Planning Area Plan as a plan for future development within an area generally bounded on the north by 31st Street Trafficway, on the west by State Line Road, on the south by Ward Parkway and on the east by Troost Avenue; and

 

WHEREAS, the Westport Planning Area Plan has been amended by Resolution No. 56687, adopted July 26, 1984; by Resolution No. 57006, adopted October 10, 1984; by Resolution No. 58324, adopted October 18, 1985; by Resolution No. 57648, adopted November 27, 1985; by Resolution No. 59731, adopted August 7, 1986; by Committee Substitute for Resolution No. 63219, adopted June 1, 1989; Resolution No. 64634, adopted November 16, 1989; Resolution No. 64797, adopted January 11, 1990; by Resolution No. 64825, adopted March 11, 1990; by Resolution No. 941429, adopted March 18, 1993; by Resolution No. 931403, adopted March 17, 1994; by Resolution No. 940741, adopted September 15, 1994; by Committee Substitute for Resolution No. 950097, adopted March 2, 1995; by Committee Substitute for Resolution No. 960778, adopted August 22, 1996; by Resolution No. 971415, adopted October 23, 1997; by Resolution No. 971635, adopted March 26, 1998; by Resolution No. 990056, adopted March 4, 1999; by Resolution No. 990554, adopted May 13, 1999; by Resolution No. 000563, adopted May 18, 2000; by Resolution No. 001069, adopted September 14, 2000; by Resolution No. 010283, adopted March 15, 2001; and by Resolution No. 020234, adopted March 28, 2002; and

 

WHEREAS, due to certain changes, it is desirable to modify certain components of the Westport Planning Area Plan by an amendment to the Land Use Plan and Map as it affects that area generally bounded by Linwood Boulevard on the north, 33rd Street on the south, Troost Avenue on the east and Campbell Street on the west, by modifying the Land Use Plan and Map to change the recommended land use designation from multi-family residential, low density, multi-family residential, medium density and retail to mixed use and an area generally bounded by 33rd Street on the north, 39th Street on the south, Troost Avenue on the east and the eastern one-half block of the area between Harrison Street and Troost Avenue, to recommend residential (mixed densities), mixed use (commercial and residential) and public/semi-public/institutional instead of multi-family residential, medium density, retail and public and semi-public uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on July 1, 2002; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on July 16, 2002; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on July 16, 2002, recommend approval of the proposed amendment to the Westport Planning Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 


Section A. That the Westport Planning Area Plan is hereby amended by repealing the Land Use Plan and Map and approving a new Land Use Plan and Map which changes the recommended land uses from multi-family residential, low density, multi-family residential, medium density and retail to mixed use (commercial and residential) for that area generally bounded by Linwood Boulevard on the north, 33rd Street on the south, Troost Avenue on the east and Campbell Street eon the west and changes the recommended land uses from multi-family residential, medium density, retail and public and semi-public uses to residential (mixed densities), mixed use (commercial and residential) and public/semi-public/institutional for that area generally bounded by 33rd Street on the north, 39th Street on the south, Troost Avenue on the east and the eastern one-half block of the area between Harrison Street and Troost Avenue. A copy of the amendment to the Land Use Plan and Map of the Westport Planning Area Plan, is attached hereto and incorporated herein by reference, as Exhibit A and is hereby approved.

 

Section B. That the amendment to the Westport Planning Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
