ORDINANCE NO. 130312

 

Rezoning a 3.8 acre tract of land generally located at the northwest corner of E. 105th Street and Holmes Road from District R-0.5 to District O-5. (8623-P-22)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0931, rezoning an area of approximately 3.8 acre tract of land generally located at the northwest corner of E. 105th Street and Holmes Road from District R-0.5 (Residential Dash 0.5) to District O-5 (Office 5), said section to read as follows:

 

Section 88-20A0931. That an area legally described as:

 

Parcel A: Lot 2, Executive Hills East 2nd Plat, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, recorded April 4, 1988 as Document No. K-821650 in Book K-37 at Page 49.

 

Parcel B: All of Lot 3, Executive Hills East, 2nd Plat, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, recorded April 4, 1988 as Document No. K-821650 in Book K-37 at Page 49, excepting however, that portion of the east 1/2 of said Lot 3 lying north of the westerly prolongation of the south line of Lot 1 as shown on said Executive Hills East, 2nd Plat.

 

Parcel C: The leasehold estate as created under an unrecorded Lease, as evidenced by that certain Memorandum of Lease recorded December 31, 1992, as Document No. K-1060274, in Book K-2338 at Page 2006, by and between the City of Kansas City, Missouri, Lessor; and Executive Hills Building D Partners, Lessee; for parking and landscaping, including employee and customer parking and for water retention structures, over what is now Lot 1, Executive Hills East, 2nd Plat, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, recorded April 4, 1988 as Document No. K-821650 in Book K-37 at Page 49, and over that portion of what is now the East 1/2 of Lot 3, Executive Hills East, 2nd Plat, a subdivision in Kansas City, Jackson County, Missouri lying North of the Westerly prolongation of the South line of said Lot 1, as shown on said Executive Hills East, 2nd Plat, and as assigned by that certain instrument filed June 19, 2007, as Document No. 2007E0080978.

 

is hereby rezoned from District R-0.5 (Residential Dash 0.5) to District O-5 (Office 5), all as shown outlined on a map marked Section 88-20A0931, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.      No wall signs are allowed on the South elevation of the building.

 

2.      The total number of wall signs for the building is limited to 2 wall signs.

 

3.      Personal Improvement Service (as defined in 88-805-04-R) is prohibited as a permitted “principal use.” A Personal Improvement Service would be permitted as an accessory use to an otherwise permitted use. For example, a professional office tenant would be permitted to have a small fitness center as part of its leased premises.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
