RESOLUTION NO. 060096

 

Approving an amendment to the Garfield/Independence Plaza Area Plan for an area of approximately 2.6 acres generally located at the southeast corner of Admiral Boulevard and the Paseo by changing the recommended land use designation from high-density residential and retail commercial uses to retail commercial uses. (201-S-7).

 

WHEREAS, on January 28, 1977, the City Council by Resolution No. 46636 adopted the Garfield/Independence Plaza Area Plan as a guide for development and redevelopment of that area bounded by the Missouri Pacific Railroad Tracks, I-35, I-70 and Prospect Avenue; and

 

WHEREAS, said Garfield/Independence Plaza Area Plan was amended on April 15, 1993, through the adoption of Resolution No. 930263, was amended on September 24, 1998, through the adoption of Resolution No. 981092, and was amended on April 15, 1999, through the adoption of Resolution No. 990382, was amended on December 16, 1999, through the adoption of Resolution No. 991463; and was further amended on April 4, 2005, through the adoption of Resolution No. 020273; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Garfield/Independence Plaza Area Plan as it affects that area of approximately 2.6 acres generally located at the southeast corner of Admiral Boulevard and the Paseo by modifying the Proposed Land Use Plan and Map for such area from high-density residential and retail commercial uses to retail commercial uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on November 21, 2005; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on January 3, 2006; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on January 3, 2006, recommend approval of the proposed amendment to the Garfield/Independence Plaza Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the sixth amendment to the Garfield/Independence Plaza Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area of approximately 2.6 acres generally located at the southeast corner of Admiral Boulevard and the Paseo by modifying the Proposed Land Use Plan and Map for such area from high-density residential and retail commercial uses to retail commercial use. A copy of the amendment to the Land Use Plan and Map of the Garfield/Independence Plaza Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Garfield/Independence Plaza Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
