COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970912

 

Declaring the 18th Street East Industrial Redevelopment Corporation to be in default of its obligations under the 18th Street East Industrial Development Plan and Redevelopment Contract; terminating said Contract and the Development Plan; and terminating rights of tax abatement and eminent domain for the 18th Street East Industrial Redevelopment Project.

 

WHEREAS, the 18th Street East Industrial Redevelopment Corporation submitted an application pursuant to Chapter 353, Revised Statutes of Missouri, for the redevelopment and rehabilitation of that area generally bounded by Benton Plaza on the north, I-70 on the east, 23rd Street on the south and Benton Avenue on the west; and

 

WHEREAS, by Committee Substitute for Ordinance No. 960083, passed March 14, 1996, the Council did approve a Development Plan and authorize the Director of Finance to enter into a contract with the 18th Street East Industrial Redevelopment Corporation; and

 

WHEREAS, there is a requirement in the Redevelopment Contract in which the Redevelopment Corporation must enter into negotiations for a period for 180 days with any property owner who desires that its property within the Plan be acquired and requests such in writing; and

 

WHEREAS, on October 21, 1996, Mr. Kurt Steinmeyer sent a written request to the 18th Street East Industrial Redevelopment Corporation requesting that Mr. Steinmeyer's property within said Plan be acquired; and

 

WHEREAS, on approximately April 25, 1997, Mr. Steinmeyer informed the City that he had not received any response from said Redevelopment Corporation in response to his request that his property be acquired; and

 

WHEREAS, the City Plan Commission held a hearing on June 17, 1997, to consider whether the 18th Street East Industrial Redevelopment Corporation should be held in default of its obligations under the Development Plan and Redevelopment Contract; and

 

WHEREAS, the City Plan Commission, after allowing all persons an opportunity to be heard, recommended that the City Council declare the 18th Street East Industrial Redevelopment Corporation to be in default of its obligations and recommended that the Redevelopment Contract and the Development Plan be terminated; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the 18th Street East Industrial Redevelopment Corporation is hereby declared to be in default of its duties and obligations under the Development Plan and Redevelopment Contract.

 

Section B. That the Council hereby terminates the 18th Street East Industrial Redevelopment Contract with the 18th Street East Industrial Redevelopment Corporation and terminates the 18th Street East Industrial Development Plan.

 

Section C. That all rights of the 18th Street East Industrial Redevelopment Corporation to tax abatements and eminent domain for said Development Plan are hereby terminated and are declared null and void and the Director of Finance is hereby authorized and directed to take all steps necessary for the execution and recordation of such declarations in accordance with this ordinance.
