ORDINANCE NO. 990406

 

Directing the Director of Convention and Entertainment Centers to execute an Amended and Restated Facilities Use Agreement with the American Royal Association and the Kansas City American Royal Arena Corporation subject to certain contingencies set out in this ordinance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Convention and Entertainment Centers Department is authorized to execute an Amended and Restated Facilities Use Agreement (the Agreement) in the nature of a sublease with the American Royal Association (the Association) and the Kansas City American Royal Arena Corporation providing for the following additional terms:

 

1. the construction and equipping of a pavillion for a livestock exercise area and equipment storage area at the American Royal Complex by the American Royal Association (the Pavillion), with $200,000.00 of the cost to be borne by the City, subject to appropriation of adequate funds for this purpose in the 1999-2000 City Budget;

 

2. the provision for use of a portion of the Pavillion by the City for storage (the Storage Area);

 

3. the sublease of the site upon which the Pavillion is to be contracted to the American Royal Association by the City for a period of 20 years;

 

4. the maintenance and repair of the Pavillion by the Association except the Storage Area;

 

5. maintenance and repair of the Storage Area by the City.

 

Section 2. That this authorization is subject to the approval of the Agreement by Kansas City Municipal Assistance Corporation.

 

Section 3. That this authorization is contingent upon receipt of a confirming opinion from nationally recognized bond counsel that the execution of the Agreement will not cause the interest on the outstanding leasehold revenue bonds to become taxable.
