COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 030116

 

Approving the sale of property at 5300 N.E. Munger Road and authorizing the Director of Finance to execute a deed therefore estimating $12,000.00 and appropriating $1,220.00 in connection with the sale; and directing the City Clerk to file certain documents with the appropriate offices.

 

WHEREAS, Resolution No. 971126 passed August 14, 1997, declared the property in excess to the Citys needs for public use and authorized the sale by competitive bids; and

 

WHEREAS, the City by that competitive bid process, received a bid from John E. Younghanz, Jr. and Linda A. Younghanz, husband and wife, and Phil Snowden and Jane Snowden, husband and wife, as tenants in common, who offered $12,200.00 for said property; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council hereby accepts the bid from John E. Younghanz, Jr. and Linda A. Younghanz, husband and wife, and Phil Snowden and Jane Snowden, husband and wife, as tenants in common in the amount of $12,200.00 for the property located at 5300 N.E. Munger Road and approves the sale of said property to them and hereby authorizes the Director of Finance to execute a Special Warranty Deed conveying the following property:

 

Beginning at the northeast corner of Lot 12, Tract No. 1 of Comptons Subdivision, in Kansas City, Clay County, Missouri; thence southwesterly along the east lines of Lots 12, 11, 10, and 9, said subdivision to the southeast corner of Lot 9; thence northwesterly along the south line of said Lot 9, 72.0 feet to a point; thence northerly along a straight line crossing Lots 9, 10, 11, and 12 to a point on the north line of Lot 12, said point being 123.0 feet northwesterly of the northeast corner of said Lot 12; thence southeasterly along the north line of said Lot 12, to the point of beginning. Subject to easements, restrictions, covenants and reservations, if any, now of record. Also, subject to the City retaining an easement for water purposes over, under and across the easterly 15 feet of said Lot 10. Also, subject to an easement to Southwestern Bell over part of Lot 9 for a utility vault.

 

Section 2. That the revenue in the following account of the Water Fund is hereby estimated in the following amount:

03-801-080-8500 Sale of City Real Estate $10,980.00

 

Section 3. That the revenue in the following account of the General Fund is hereby estimated in the following amount:

 

03-100-064-8500 Sale of City Real Estate $ 1,220.00

 

Section 4. That the sum of $ 1,220.00 is hereby appropriated from the Unappropriated Fund Balance of the General Fund to the following account in the General Fund:

03-100-064-2025-B Property and Relocation Services $ 1,220.00

 

Section 5. That the City Clerk is hereby directed to record a copy of this ordinance in the office of the Recorder of Deeds for Clay County at Liberty, Missouri, as evidence of the sale of the herein described property by the City.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
