RESOLUTION NO. 140661

 

Amending the Eastgate Land Use and Development Plan, on an approximately 1 acre tract of land generally located at the southeast corner of 58th Street and Crystal Avenue, by changing the recommended land use from residential to residential with limited commercial operated accessory to the residence. (568-S-4)

 

WHEREAS, on December 20, 2001, the City Council by Resolution No. 011676 adopted the Eastgate Land Use and Development Plan as a guide for the future development and redevelopment for the area generally bounded by the Missouri Pacific Railroad line on the west, Interstate 435 on the east, Coal Mine Road on the north and 63rd Street Trafficway on the south; and

 

WHEREAS, an application was submitted by William and Teresa Rice to amend the Eastgate Land Use and Development Plan as it affects a 1 acre tract of land generally located at the southeast corner of 58th Street and Crystal Avenue by changing the recommended land use from residential to commercial; and

 

WHEREAS, the City Plan Commission considered such amendment to the aforementioned area plan on May 20, 2014; and

 

WHEREAS, after all interested parties were given an opportunity to present testimony, the City Plan commission recommended approval of the application with modifications, on May 20, 2014; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Eastgate Land Use and Development Plan is hereby amended for the 1 acre tract of land generally located at the southeast corner of 58th Street and Crystal Avenue by changing the recommended land use from residential to residential with limited commercial operated accessory to the residence. A copy of the amendment to the Eastgate Land Use and Development Plan is attached hereto as Exhibit A and is incorporated herein by reference.

 

Section B. That the Amendment to the Eastgate Land Use and Development Plan is consistent and complies with the FOCUS Kansas City Plan adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed area plan amendment hereinabove, all public notices have been given and hearings have been held as required by law.
