COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090665

 

Authorizing the Directors of Aviation and Public Works to execute amendments to cooperative agreements with the Tax Increment Financing Commission; reducing appropriations in the Capital Improvements Sales Tax Fund; and appropriating $300,000.00 for improvements to N. Amity Avenue beginning at Tiffany Springs Road and running south approximately 1,800 feet.

    

WHEREAS, on October 4, 2007, Second Committee Substitute for Ordinance No. 070966 authorized the Director of Aviation to execute a cooperative agreement with the Tax Increment Financing Commission for improvements to Tiffany Springs Parkway at I-29; and

 

WHEREAS, the City desires to amend the previously executed cooperative agreement to include improvements, subject to appropriation, to Tiffany Springs Parkway from I-29 to I-435; and

 

WHEREAS, on November 6, 2008, Committee Substitute for Ordinance No. 081057 authorized the Director of Public Works to execute a cooperative agreement with the Tax Increment Financing Commission for improvements to Tiffany Springs Road at N. Amity and encumbered and allocated $1,550,000.00 for that purpose; and

 

WHEREAS, $800,000.00 of the $1,550,000.00 allocated were Second Council District Neighborhood Conservation Funds; and

 

WHEREAS, the improvement costs for Tiffany Springs Road at N. Amity are under budget and $400,000.00 of the Capital Improvement Sales Tax Funds remain; and

 

WHEREAS, the City wishes to cause the design and construction of improvements to N. Amity Avenue beginning at Tiffany Springs Road, running south approximately 1,800 feet, and to amend the previously executed cooperative agreement with the Tax Increment Financing Commission for that purpose; and

 

WHEREAS, the improvements to N. Amity are estimated to cost $700,000.00; and

 

WHEREAS, the improvements will be funded by the surplus $400,000.00 in Capital Improvement Sales Tax Funds previously advanced to the Tax Increment Financing Commission and the $300,000.00 appropriated herein; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Aviation is hereby authorized to execute an amendment to a cooperative agreement with the Tax Increment Financing Commission, as previously authorized by Second Committee Substitute for Ordinance No. 070966, to include improvements, subject to appropriation, to Tiffany Springs Parkway from I-29 to I-435. The agreement is approved in substantial form as that on file in the office of the Director of Aviation, subject to the receipt of all required approvals.

 

Section 2. That the appropriations in the following accounts of the Capital Improvements Sales Tax Fund are reduced by the following amount:

Section 3. That $300,000.00 is appropriated from the Unappropriated Fund Balance of the Capital Improvements Sales Tax Fund to the following account in the Capital Improvements Sales Tax Fund:

Section 4. That the Director of Public Works is hereby authorized to execute an amended public infrastructure funding agreement with the Tax Increment Financing Commission, as previously authorized by Ordinance No. 081057, for the purpose of providing for the design and construction of street improvements to N. Amity Avenue beginning at Tiffany Springs Road, running south approximately 1,800 feet. The amended agreement is approved in substantial form as that on file in the office of the Director of Public Works, subject to the receipt of all required approvals, and shall provide that Citys previous contribution shall be supplemented in an amount not to exceed $300,000.00, as appropriated in Account No. 10-3090-898201-B.
