ORDINANCE NO. 090838

 

Approving an amendment to a previously approved preliminary development plan in District M-1p on approximately 13.0 acres generally located at 8601 E. Highway 40, on the south side of Highway 40, approximately 1,000 feet east of the I-435 interchange (8984-P-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary development plan in District M-1p (Light Industry - Limited District) on approximately 13.0 acres generally located at 8601 E. Highway 40, on the south side of Highway 40, approximately 1,000 feet east of the I-435 interchange, and more specifically described as follows:

 

TRACT 1: All that part of the Southeast 1/4 of the Southeast 1/4 of Section 18, Township 49, Range 32, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the southwest corner of said 1/4 1/4 Section; thence north along the west line of said 1/4 1/4 Section, 1163.87 feet to the southerly line of U.S. Highway No. 40; thence easterly along said southerly line 533.12 feet to a point that is 810.27 feet westerly of the east line of said 1/4 1/4 Section, measured parallel with the centerline of U.S. Highway No. 40; thence south along a line that makes a southeast angle of 76 degrees 16 minutes 25 seconds with the south line of U.S. Highway No. 40, 1112.21 feet to the south line of said 1/4 1/4 Section; thence west along said south line, 533.08 feet to the point of beginning, except that part deeded to Yellow Freight System, Inc. in the Quit Claim Deed filed in Book I-2005 at page 1882 as Document No. I-966842.

 

TRACT 2: A non-exclusive easement for ingress and egress, parking, and utilities as established in the instrument recorded March 28, 1988, as Document No. I-834063, in Book I-1784, page 105, over the following described land: All that part of the Northeast 1/4 of the Northeast 1/4 of Section 19, Township 49, Range 32, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the northwest corner of the Northeast 1/4 of the Northeast 1/4; thence east on the north line of said 1/4 1/4 Section, a distance of 533.08 feet; thence south and parallel to the west line of said 1/4 1/4 Section a distance of 15 feet; thence west and parallel to the north line of said 1/4 1/4 Section, a distance of 533.08 feet to a point on the west line of said 1/4 1/4 Section; thence north on the west line of said 1/4 1/4 Section, a distance of 15 feet to the point of beginning. all except that part taken in Booth Avenue by documents filed for record, as Document No. 770881, in Book 1518, at page 681, recorded June 28, 1961, or Document No. 912736, in Book 1898, at page 31 recorded July 28, 1967, in the records of Jackson County, Missouri, now being a portion of Lot 1 of Yellow Freight System, Inc.-KCM Terminal, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit a detailed micro storm drainage study prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services prior to issuance of any certificate of occupancy.

 

2.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

3.                  That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

4.                  That the developer grant a BMP Easement to the City, as required by Development Services, prior to issuance of any certificate of occupancy.

 

5.                  That the developer remove the 60 foot wide strip of asphalt adjacent to the right of way for U.S. 40.

 

6.                  That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, building elevations and photometric study showing zero footcandles at the property lines.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 001498, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
