SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 981321

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0181, rezoning an area of approximately 8.5 acres generally located between N. Winan Road and N.W. Interurban Road at approximately N.W. 140th Street from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-1 (General Industry), and approving a development plan for the same. (12175-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0181, rezoning an area of approximately 8.5 acres generally located between N. Winan Road and N.W. Interurban Road at approximately N.W. 140th Street from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-1 (General Industry), said section to read as follows:

 

Section 80-11A0181. That an area legally described as:

 

A tract of land in part of the Southwest Quarter of Section 2, Township 52, Range 34, in Kansas City, Platte County, Missouri, described as follows: Commencing at the center of said Section 2; then west along the north line of said Quarter Section, 100 feet for a true point of beginning; then south parallel to the east line of said Quarter Section, 750 feet; then west parallel to the north line of said Quarter Section, 350 feet; then north parallel to the east line of said Quarter Section, 700 feet; then west along a line parallel to and 50 feet south of the north line of said Quarter Section, 2168 feet more or less to a point on the east right of way line of Winan Road; then north along said right of way line, 50 feet to a point on the north line of said Quarter Section; then east along the north line of said Quarter Section, 2518 feet more or less to the point of beginning. This tract contains 8.5 acres more or less.

 

is hereby rezoned from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-1 (General Industry), all as shown outlined on a map marked Section 80-11A0181, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer extend water mains as required by the Water Services Department.

 

2. That the developer provide for fire protection as required by the Fire Department.

 

3. That the developer comply with the Kansas City International Airport height zoning restrictions and that no structure in this area be constructed which exceeds these zoning restrictions.

 

4. That the developer grant an Aviation Noise Easement to the City as required by the Aviation Department.

 

5. That the developer enter into a Cooperative Agreement with the City whereby the developer will improve N. Winan Road from the access drive to the asphalt plant, south approximately one mile, to the N. Access Road, by widening N. Winan Road to a pavement width as required by the Department of Public Works and to a depth which will accommodate 50 ton trucks prior to the approval of a final plan by the City Plan Commission.

 

6. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading and signage.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 981321, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
