ORDINANCE NO. 180150

 

Declaring certain real property generally located in the Beacon Hill Redevelopment Area in Kansas City, Missouri, surplus to the City's needs; authorizing the Director of General Services to offer the sale of the City’s interest in this real property in accordance with City regulations, to later convey it; and execute related documents to complete the transfer of the real property to continue development of the Beacon Hill project.

 

WHEREAS, the City owns rights in certain real property generally located along Forest Avenue and Tracy Avenue from 25th to 27th Streets, more fully described below, in Kansas City, Missouri; and

 

WHEREAS, the City Manager has determined on behalf of all City departments that the parcels of real property set out below are in excess to the needs of the City and no interest has been expressed by any City department in retaining the land for public use; and

 

WHEREAS, these properties in the Beacon Hill project area have been identified for redevelopment by the City Manager and thus are surplus to the City’s needs; and

 

WHEREAS, a Request for Qualifications and Proposals was issued by the City on October 5, 2017, for redevelopment of the properties; and

 

WHEREAS, certain recorded easements affecting the real property, but benefitting the City, shall remain in effect and any conveyance out of the City shall be specifically subject to existing recorded easements and encumbrances, and dedicated right of way for public streets, which shall be deemed retained by the City, as more fully set forth in the subsequent transfer deed; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the property described below, is hereby declared surplus to the City’s needs.

 

Section 2. That the Director of General Services Department is hereby authorized to offer and sell, in accord with City regulations and made available through an open and public competition, the City’s rights in the properties, which is legally described as follows:

Tract 1. Parcel 29-630-20-21-00-0-00-000

The North half of Lot 18, Block 5, Continuation of Beacon Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

Commonly known as 2522 Forest, Kansas City, Jackson County, Missouri.

Tract 2. Parcel 29-630-20-27-00-0-00-000

Lots 19, 20, 21 and 22, Block 5, Continuation of Beacon Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

Section 3. That certain easements or other encumbrances of record are being retained on behalf of the City and will be expressly listed as retained on the Special Warranty Deed to be executed by the City so as to subject such conveyance to such easements and encumbrances.

 

Section 4. That as a part of the request for proposal process, the General Services Department staff shall require a proposer to provide a scope of work to construct new, residential housing with a construction timeline, and identify sources of funding for such construction, with the General Services Department staff obtaining security for the completion of such construction commitments in a form determined appropriate by such Director, including without limitation, a performance deed of trust.

 

Section 5. That the Director of General Services is hereby authorized to execute any real estate or other documents needed to effectuate the transaction described herein.
