ORDINANCE NO. 990310

 

Enacting a new Section 2-1021, Code of Ordinances, entitled Municipal Hotline requiring the City Manager to establish a hotline for the purpose of receiving reports from any person of alleged inappropriate and unlawful conduct of elected officials, members of appointed boards and commissions, contract employees, employees of the City, and those doing business with the City.

 

WHEREAS, a special Council Ethics/Relations Committee was appointed by the Mayor to develop guidance for the City Council on the proper interaction between the Council and City staff and to improve ethics in City government; and

 

WHEREAS, during 1997 and 1998 the Council Ethics/Relations Committee met with former Mayors, Council members, City staff, the United States Attorney, and members of the public to study the issues and learn of opportunities available to the Council to accomplish its charge; and

 

WHEREAS, the Council Ethics/Relations Committee has concluded that the establishment of a Municipal Hotline will provide a new and effective way to receive reports of alleged inappropriate or unlawful conduct of elected officials, members of appointed boards and commissions, contract employees and employees of the City, and those doing business with the City; and

 

WHEREAS, a subcommittee of the Administrative Services Committee has also studied the operation of a hotline and has made recommendations concerning the appropriate development of a Municipal Hotline; and

 

WHEREAS, this Municipal Hotline will be the type of tool envisioned by the State of Missouri when it concluded that the operation of such a hotline will be enhanced if records of calls made and other records of the operation of the hotline should be closed records, thereby benefitting the people of the City of Kansas City by encouraging reporting of questionable behavior of public servants; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That a new Section 2-1021, Code of Ordinances, is enacted to read as follows:

 

Sec. 2-1021. Municipal Hotline

 

(a) Establishment of hotline. The city manager will establish a Municipal Hotline for the purpose of reporting by City personnel of suspected abuse and wrongdoing by elected officials, members of appointed boards and commissions, contract employees, employees of the City, and those doing business with the City. Following successful implementation of the hotline for internal use it will be expanded to take information from other appropriate sources.

 

(b) False statements. It is unlawful for any person to knowingly make a false report or statement through the Municipal Hotline. Violation of this section may be punished by a fine not to exceed $500.00 or incarceration for a period not to exceed 180 days, or both such fine and incarceration.
