ORDINANCE NO. 980819
Amending Chapter 80, Code of Ordinances, by
adding a new section to be known as Section 80-11A0151, rezoning an area of
approximately 38.3 acres generally located on the north side of Tiffany Springs
Parkway, approximately 1600 feet east of N.W. Skyview Avenue, from District
GP-6 (Low Density Residential Uses) to District GP-3 (Regional Business Uses),
and approving a development plan for the same. (10647-GP-4)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That Chapter 80, Code of
Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the
Zoning Ordinance, is hereby amended by enacting a new section to be known as
Section 80-11A0151, rezoning an area of approximately 38.3 acres generally
located on the north side of Tiffany Springs Parkway, approximately 1600 feet
east of N.W. Skyview Avenue, from District GP-6 (Low Density Residential Uses)
to District GP-3 (Regional Business Uses), said section to read as follows:
Section 80-11A0151. That an area
legally described as:
Part of the Southeast
1/4 of Section 31, Township 52 North, Range 33 West of the 5th Principle
Meridian, in Kansas City, Platte County, Missouri, described as follows:
Commencing at the northwest corner of said Southeast 1/4; thence South
039'49" West (all bearings herein are referenced to the Missouri State
Plane Coordinate System 1983, West Zone) on the west line of said Southeast
1/4, 148.93 feet to the northwest corner of Lot 1, Tiffany Greens Addition, a
subdivision of land in Kansas City, Platte County, Missouri; thence South
6736'14" East on the northerly line of said Lot 1, 305.66 feet to the
northeast corner of said Lot 1 and the point of beginning; thence continuing South
6736'14" East, 160.00 feet; thence North 4610'51" East, 116.52
feet; thence North 3729'13" East, 222.49 feet; thence North
4941'25" East, 235.76 feet; thence North 9000'00" East, 262.48
feet; thence South 1828'57" East, 521.19 feet; thence South 5116'05"
East, 599.09 feet; thence South 4802'23" East, 172.15 feet; thence South
3436'14" East, 240.00 feet; thence South 2802'29" East, 350.00;
thence South 1118'33" East, 132.65 feet to a point on a curve; thence
northwesterly on a curve to the right (said curve having an initial tangent
bearing of South 7841'27" West, a radius of 1130.00 feet, chord bearing
North 8209'16" West, chord distance of 741.55 feet) an arc distance of
755.54 feet; thence North 6300'00" West, 430.92 feet to a point of curvature;
thence northwesterly on a curve to the left (said curve being tangent to the
last described course, having a radius of 1470.00 feet, chord bearing North
6930'00" West, chord distance of 332.82 feet) an arc distance of 333.53
feet; thence North 7600'00" West, 399.10 feet to a point of curvature on
the south right of way line of Tiffany Springs Parkway; thence northwesterly on
a curve to the left on said south right of way line (said curve being tangent
to the last described course, having a radius of 778.00 feet, chord bearing
North 8014'40" West, chord distance of 115.20 feet) an arc distance of
115.31 feet to the east line of Thornhill, a subdivision of land in Kansas
City, Platte County, Missouri; thence North 530'30" East on said east
line, 141.03 feet;
thence North
830'00" West on said east line, 322.18 feet; thence North 1330'00"
East on said east line, 175.39 feet to the southeast corner of said Lot 1,
Tiffany Greens Addition; thence continuing North 1330'00" East on the
east line of said Lot 1, 116.16 feet to the point of beginning. (Subject tract
contains 38.3 acres, more or less.)
is hereby rezoned from District GP-6 (Low
Density Residential Uses) to District GP-3 (Regional Business Uses), all as
shown outlined on a map marked Section 80-11A0151, which is attached hereto and
made a part hereof, and which is hereby adopted as a part of an amendment to
the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That a development plan
for the area legally described above is hereby approved, subject to the
following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any
improvements as required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer identify floodway and floodplain boundaries on the final plat as
required by the Department of Public Works.
5. That
the developer extend water mains as required by the Water Services Department.
6. That
the developer grant an Aviation Noise Easement to the City.
7. That
the developer enter into a Fair Disclosure Agreement to provide disclosure at
the time of any real estate transaction.
8. That
the developer extend sanitary sewers to serve each living unit and the golf
course clubhouse as required by the Department of Public Works.
9. That
the developer prohibit any structure that exceeds the height as defined on the
KCI Airport Zoning Map.
10. That
the developer provide for fire protection as required by the Fire Department.
11. That
the developer dedicate additional right of way for Tiffany Springs Parkway as
required by the Department of Public Works so as to provide a maximum of 200
feet of right of way for Tiffany Springs Parkway.
12. That
the developer improve Tiffany Springs Parkway to parkway street standards,
including grading full width and constructing two lanes.
13. That
the developer petition for the vacation of Old Stagecoach Road as required by
the Department of Public Works.
14. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
15. That
the developer design and install streetlights as required by the Department of
Public Works.
16. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping, berming, lighting, grading and signage.
A copy of said development plan is on file in
the office of the City Clerk under Document No. 980819, which is attached
hereto and made a part hereof.
Section C. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
