SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090495

 

Reducing an appropriation in the Capital Improvements Fund in the amount of $5,500,000.00; transferring $500,000.00 from the Public Safety Sales Tax Fund to the Capital Improvements Fund; specifying surface transportation projects for reallocation of funds due to the American Recovery and Reinvestment Act of 2009; directing the Public Improvements Advisory Committee to allocate $1,000,000.00 for the next fiscal year in City-wide funds for the Troost Bridge project; and recognizing an emergency.

 

WHEREAS, on April 16, 2009, the City Council passed Second Committee Substitute for Ordinance No. 090219 setting the process for reallocation of funds due to the American Recovery and Reinvestment Act of 2009; and

 

WHEREAS, the Troost Bridge surface transportation project will receive approximately $13,000,000.00 in Surface Transportation Grants from the American Recovery and Reinvestment Act of 2009; and

 

WHEREAS, the Troost Bridge surface transportation project budget has recently been reestimated to increase by 25% from $20,000,000.00 to $25,000,000.00; and

 

WHEREAS, approximately $8,000,000.00 is available for reappropriation due to American Recovery and Reinvestment Act of 2009 Surface Transportation Grants for the Troost Bridge surface transportation project; and

 

WHEREAS, reallocation of funds will allow construction-ready surface transportation projects in addition to the Troost Bridge project to proceed, creating jobs, economic activity, and benefits throughout the City; and

 

WHEREAS, $500,000.00 was borrowed from the Troost Bridge account to provide stopgap funding on the Police Academy and never repaid to the Troost Bridge account; and

 

WHEREAS, the Public Improvements Advisory Committee has reviewed this ordinance and its list of surface transportation projects; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the appropriations in the following accounts of the Capital Improvements Fund are hereby reduced by the following amounts:

 

10-3090-898833-B Troost Ave. Bridge over Brush $1,190,432.00

10-3090-808055-B Brush Creek Troost Channel 1,396,301.00

10-3090-807521-B 2006 Budget 539,601.00

10-3090-807521-A Budget Integration Account 259,998.00

10-3090-807521-A Brush Creek Flood Mitigation 119,376.00

10-3090-707520-B Brush Creek Enhancement 1,994,292.00

TOTAL $5,500,000.00

Section 2. That $500,000.00 is appropriated from the Unappropriated Fund Balance of the Public Safety Sales Tax Fund (No. 2320) to the following account:

 

10-2320-129998-903090 Transfer to C.I.P. Fund $ 500,000.00

 

Section 3. That revenue is estimated in the following account of the Capital Improvements Fund:

 

10-3090-120000-502320 Transfer from Public Safety Sales Tax Fund $ 500,000.00

 

Section 4. That the following surface transportation projects that are ready for construction are to be added to the capital budget in the following amounts:

 

Red Bridge Rd (CD6) $1,000,000.00

Phelps Road (CD5) 1,000,000.00

Volker and Oak Turn Lane (CD4) 500,000.00

Stadium Drive (CD3) 1,000,000.00

N Congress (CD2) 1,000,000.00

N Bennington Rd (CD1) 1,500,000.00

TOTAL $6,000,000.00

 

Section 5. That the City Council intends to appropriate funding for each project as needed to cash flow each project.

 

Section 6. That the Public Improvements Advisory Committee shall include $1,000,000.00 for the Troost Bridge project in FY11 citywide funding.

 

Section 7. That this ordinance is recognized as an emergency measure within the provisions of Section 503(a)(3)(C) of the Charter in that it appropriates money and shall take effect immediately upon its passage

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
