Approving an amendment to a previously approved Community
Unit Project on a 242.7 acre tract of land generally located on the west side
of U.S. Highway 169 between Cookingham Drive and N.W. 108th Street.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on a 242.7 acre tract of land generally located
on the west side of U.S. Highway 169 between Cookingham Drive and N.W. 108th
Street, and more specifically described as follows:
All that part of the Southeast Quarter of Section
22, and all that part of the Northeast Quarter of Section 27, all in
Township 52, Range 33, Kansas City, Clay County, Missouri, being bounded
and described as follows: Beginning at the southwest corner of the
Southeast Quarter of said Section 22; thence North 009'15" East
along the west line of said Southeast Quarter, 1314.39 feet to the
northwest corner of the south one-half of said Southeast Quarter; thence
South 8943'36" East along the north line of the south one-half of
said Southeast Quarter, 198.00 feet; thence North 009'15" East,
parallel with the west line of said Southeast Quarter, 1283.81 feet to a
point on the south right of way line of Missouri State Highway Route 291,
as now established; thence South 8947'55" East along said right of
way line, 622.32 feet; thence South 012'05" West, 595.00 feet;
thence South 8947'55" East, 1067.47 feet to a point on the westerly
right of way line of N.W. Arrowhead Trafficway, (U.S. Highway No. 169), as
now established; thence southeasterly along said right of way line, on a curve
to the left, having an initial tangent bearing of South 048'42"
East, a radius of 490.00 feet, an arc distance of 408.99 feet; thence
South 4838'04" East along said right of way line, tangent to the
last described curve, 100.00 feet; thence southeasterly along said
right of way line, on a curve to the right, tangent to the last described
course, having a radius of 894.93 feet, an arc distance of 578.35 feet;
thence South 335'49" West along said right of way line, 215.50
feet; thence South 001'53" West along said right of way line,
1000.08 feet; thence South 219'25" West, along said right of way
line, 1245.78 feet; thence South 3106'20" West, along said right of
way, 114.51 feet; thence South 214'03" West, along said right of
way, 328.48 feet; thence south 1405'44" West, along said right of
way, 185.79 feet; thence North 8928'05" West, 719.82 feet;
thence South 031'55" West, 50.00 feet; thence South 8928'05"
East, 115.00 feet; thence South 031'55" West, 505.24 feet to a point
on the north line of N.W. 108th Street, as now established; thence South
7845'42" West, along said north line, 229.02 feet; thence South
004'18" West, 20.01 feet; thence North 8955'42" West, along
said north line, 1441.36 feet to a point on the west line of said
Northeast Quarter, said point being 36.10 feet north of the southwest
corner of said Northeast Quarter; thence North 050'53" East along
said west line, 2600.99 feet to the northwest corner of the Northeast
Quarter of said Section 27, said point being the point of beginning.
Containing 241.44 acres, more or less.
is hereby approved, subject to the following conditions:
1. That the developer secure a floodplain
certificate for any grading or building within the floodplain.
2. That the developer secure the approval of the
Board of Zoning Adjustment for any freestanding signs.
3. That the developer establish a homes
association for the care and maintenance of the private open space.
4. That the developer dedicate 50 feet of right of
way from centerline for Cookingham Drive.
5. That the developer improve one-half of
Cookingham Drive to City standards for arterial streets, including
curbs,
gutters, sidewalks and streetlights.
6. That the developer dedicate 100 feet of right
of way from centerline for N.W. 108th Street.
7. That the developer improve one-half of N.W.
108th Street to City standards for parkways, including curbs,
gutters,
sidewalks and streetlights.
8. That the developer secure the approval of the
Street Naming Committee for all street names.
9. That the developer construct temporary
cul-de-sacs as required.
10. That the developer submit a storm drainage
study to the City Engineer, including provision for any needed
improvements, for the entire development when
the first
plat is submitted.
11. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances of Kansas City, Missouri, as
amended, commonly
known as the Subdivision Regulations.
12. That the developer extend water mains in
accordance with current City standards and regulations.
13. That the developer extend sanitary sewers in
accordance with City standards and regulations.
14. That the developer submit a final plan for
review and approval by the City Plan Commission prior to the
issuance of building permits.
15. That the developer provide a buffer strip of at
least 50 feet in depth in addition to the normal lot depth
requirement for those lots backing onto a
public street
or limited access highway in accordance with
Section
31.26.
16. That the developer comply with the Kansas
City International Airport height zoning restrictions for any
structures.
17. That the developer obtain a land disturbance
permit from the Missouri Department of Natural Resources.
18. That the developer receive the approval of the
Missouri Highway and Transportation Department for any work within
State right of way.
19. That the developer receive the approval of the
Director of the Department of Public Works for the locations of
intersections or drives.
20. That the developer enter into an agreement with
the State and the City to signalize the intersection of N.W.
Cookingham Drive and Highway 169.
21. That the developer submit a street planting
plan as a part of the final plat and secure the approval of the
City Forester for street trees planted on right
of way.
A copy of said Community Unit Project amendment is on
file in the office of the City Clerk under Document No. 931506, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
