COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 020284

Authorizing a $423,160.00 Cooperative Agreement with the Missouri Highways and Transportation Commission to assist in the improvement and enhancement of the Vivion Road Trail-Phase 2 extending from the vicinity of 47th Street going east toward Highland Avenue; estimating revenue in the amount of $423,160.00 in the Capital Improvement Fund; appropriating it to the Vivion Road Trail Phase 2 account of the Capital Improvement Fund; rolling forward unexpended and unencumbered funds in that fund for Fiscal Year 2002-03; and directing the City Clerk to record the agreement.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of the Department of City Development is hereby authorized to enter into and execute, on behalf of the City, a $423,160.00 CMAQ Agreement - Congestion Mitigation and Air Quality Agreement with the Missouri Highways and Transportation Commission being CMAQ-9900(413), to assist in the improvement and enhancement of the Vivion Road Trail-Phase 2 extending from the vicinity of 47th Street going east toward Highland Avenue. The agreement shall essentially be in the form attached hereto and incorporated herein by reference.

Section 2. That the revenue in the following account of the Capital Improvement Fund is hereby estimated in the following amount:

02-309-064-7172 Grant Revenue $423,160.00

Section 3. That the sum of $423,160.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvement Fund to the following account in the Capital Improvement Fund:

02-309-064-7120-T Vivion Road Trail Phase 2 $423,160.00

Section 4. That the Director of City Development is hereby designated as requisitioning authority for Account No. 02-309-064-7120.

Section 5. That the unexpended and unencumbered balance of appropriations in Account No. 02-309-064-7120 and the uncollected balance in revenue Account No. 02-309-064-7172 are hereby appropriated to the same accounts in the 2002-03 Fiscal Year.

Section 6. That the City Clerk is hereby directed to record copies of the Cooperative Agreement in the office of the Secretary of State of Missouri, and in the office of the Director of Records for Jackson County, Missouri at Kansas City as required by Section 70.300 of the Revised Statutes of Missouri.
