ORDINANCE NO. 940588

 

Approving an amendment to a previously approved development plan in District GPC (Commercial) on a 12.41 acre tract of land generally located at the southeast corner of Raytown Road and Sherer Parkway. (9638-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GPC (Commercial) on a 12.41 acre tract of land generally located at the southeast corner of Raytown Road and Sherer Parkway, and more specifically described as follows:

 

All that part of the Northeast Quarter of the Northeast Quarter of Section 20, Township 47, Range 32, in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at a point on the west line of said 1/4 1/4 Section, 77.28 feet south of the northwest corner thereof, said point being on the base line for right of way for Sherer Parkway as proposed; thence east along said base line, 477.58 feet; thence east and northeasterly along said base line, being a curve to the left, from the last described course as a tangent, having a radius of 1145.92 feet, and a central angle of 1200'00", a distance of 240 feet; thence southeasterly, normal to the last described curve and no longer along said base line, a distance of 39.35 feet; thence southeasterly along a curve to the left, from the last described course as a tangent, having a radius of 600 feet, and a central angle of 4859'25", a distance of 513.02 feet; thence southwesterly, normal to the last described curve, 12.74 feet; thence southwesterly and west along a curve to the right, from the last described course as a tangent, having a radius of 400 feet and a central angle of 6052'04", a distance of 424.94 feet; thence west, tangent to the last described curve, and parallel with the south line of said 1/4 1/4 Section, a distance of 659.69 feet to a point on the west line of said 1/4 1/4 Section; thence north along said west line, 632.00 feet to the point of beginning; excepting therefrom that part, if any, now in public way. Containing 12.41 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer extend water mains as required by the Water Department.

 

3. That the developer provide for fire protection as required by the Fire Department.

 

4. That the developer submit a storm drainage study to the City Engineer's Office for approval, including provision

for any needed improvements.

 

5. That the developer extend off-site sanitary sewers to serve each building with a separate sewer service

connection.

 

6. That the developer dedicate additional right of way on the east side of Raytown Road, if required by the City,

for a total of 50 feet of right of way from centerline.

 

7. That the developer improve the east-half of Raytown Road to primary arterial street standards including curbs,

gutters, sidewalks and streetlights.

 

8. That the developer submit a landscaping plan for each phase of the development prior to the issuance of a

building permit.

 

9. That the developer grant a noise and aviation easement to the City.

 

10. That the developer state on all plans and plats that the proposed development is located within the area of the

Richards-Gebaur Air Force Base Height Restrictions and

that no structure shall be built which exceeds these

restrictions.

 

11. That the developer secure a floodplain certificate prior to any work within the 100 year floodplain.

 

12. That the developer submit plans for the review and approval of the Public Works Department for any island

cuts in Sherer Parkway and for the need for left turn and

right turn lanes.

 

13. That the developer provide a full disclosure statement.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 940578, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
