ORDINANCE NO. 001616
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0328,
rezoning an area of approximately 6.2 acres generally located at the northeast
corner of 26th Street and Grand Avenue from District M-1 (Light Industry) to
District URD (Urban Redevelopment District), and approving a development plan
for the same. (12485-URD)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0328, rezoning an area of
approximately 6.2 acres generally located at the northeast corner of 26th
Street and Grand Avenue from District M-1 (Light Industry) to District URD
(Urban Redevelopment District), said section to read as follows:
Section
80-11A0328. That an area legally described as:
That part of Lots 11, 12, and 13, Scarritt
& Peerys Subdivision, part of Lots 1 and 20, Boutons 2nd Addition, and
part of Lots 1 and 17, Block 1, Vanderventor Place, all being subdivisions in
Kansas City, Jackson County, Missouri, together with that part of vacated
Warwick Trafficway, that part of vacated Grand Avenue, that part of vacated
26th Street, that part of vacated McGee Street Trafficway, that part of the
vacated alley lying between said Lots 1 and 20, Boutons 2nd Addition and
that part of the vacated alley lying between said Lots 1 and 17, Block 1,
Vanderventor Place, being more particularly described as follows: Beginning
at a point 3.05 feet south of the intersection of the south right of way line
of 26th Street, as now established and the east line of vacated McGee Street
Trafficway, as measured along said east line; thence North 0E00'00" East along said east line of
vacated McGee Street Trafficway, a distance of 473.09 feet; thence North 90E00'00" West, departing said east
line, a distance of 381.87 feet; thence South 0E01'33" West, a distance of 122.10 feet;
thence North 89E42'59" West, a
distance of 245.68 feet to a point 12.00 feet easterly of, as measured
perpendicular to, the easterly right of way line of Grand Boulevard as
established by Ordinance No. 900744; thence South 21E28'37" West along a line 12.00 feet
easterly of, and parallel with, said easterly right of way line, a distance of
33.37 feet; thence southerly, continuing along said parallel line, along a
curve to the left, tangent to the last described course, having a radius of
398.00 feet and a central angle of 21E26'35",
an arc distance of 148.95 feet; thence South 0E02'02" West, continuing along said parallel
line, a distance of 93.55 feet to a point on the northeasterly right of way
line of said Grand Boulevard; thence South 44E43'09" East along said northeasterly right
of way line, a distance of 6.31 feet; thence South 89E44'00" East along the northerly right
of way line of said Grand Boulevard, a distance of 104.32 feet; thence South 0E16'00" West along the east right of
way line of said Grand Boulevard, and its southerly prolongation, a distance of
77.15 feet; thence South 90E00'00"
East, a distance of 559.11 feet to the point of beginning. Containing 270,320
square feet or 6.206 acres, more or less.
is
hereby rezoned from District M-1 (Light Industry) to District URD (Urban
Redevelopment District), all as shown outlined on a map marked Section
80-11A0328, which is attached hereto and made a part hereof, and which is
hereby adopted as a part of an amendment to the zoning maps constituting a part
of said chapter and as an amendment to Section 80-11 thereof.
Section
B. That a development plan for the area legally described above is hereby
approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any necessary improvements as required by
the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer provide for fire protection as required by the Fire Department.
7. That
the developer extend or realign sanitary sewers as required by the Department
of Public Works.
8. That
the developer extend or relocate water mains as required by the Water Services
Department.
9. That
the developer petition for the vacation of 26th Street, McGee Street and Warwick
Trafficway as required by the Department of Public Works.
10. That
the developer dedicate 12 feet of additional right of way on the east side of
Grand Avenue beginning at 26th Street and going north approximately 350 feet as
required by the Board of Parks and Recreation Commissioners.
11. That
the developer dedicate 12 feet of additional right of way on the east side of
Grand Avenue from 26th Street south to 27th Street as required by the
Department of Public Works.
12. That
the developer construct a traffic signal at the intersection of 26th Street and
Grand Avenue as required by the Department of Public Works.
13. That
the developer provide a hardwire interconnect between signals on Grand Avenue
between 26th Street and Main Street as required by the Department of Public
Works.
14. That
the developer provide for a truck loading and unloading dock on the premises as
required by the Department of Codes Administration.
15. That
the developer submit a site plan to the Director of the Department of City
Development for approval prior to the issuance of a building permit. The site
plan shall include information regarding property uses, setback distances,
lighting, landscaping and architectural characteristics.
A
copy of said development plan is on file in the office of the City Clerk under
Document No. 001616, which is attached hereto and made a part hereof.
Section
C. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
