ORDINANCE NO. 951200

 

Accepting various easements and deeds in Jackson, Clay and Platte Counties; releasing various easements; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Jackson County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

Section 3. That various easements in Kansas City, Platte County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

 

1. Storm Drainage Easement from QuikTrip Corporation, Instrument No. 0008330, book 831, page 264;

 

2. Storm Drainage Easement from BBP Associates, Instrument No. 0008331, book 831, page 265;

 

3. Standard Sewer Easement from BBP Associates, Instrument No. 0008332, book 831, page 266;

 

4. Standard Sewer Easement from QuikTrip Corporation, Instrument No. 0008333, book 831, page 267;

 

all recorded in the office of the Recorder of Deeds for Platte County, Missouri, at Platte City, are hereby accepted.

 

Section 4. That the legal descriptions for such properties listed in Sections 1 through 3 are set forth in Exhibit "A", which is attached hereto and incorporated herein by reference.

 

Section 5. That the 5 foot utility easement reserved in the Declaration of Restrictions and recorded in the office of the Recorder of Deeds for Jackson County, Missouri, at Kansas City, as Document No. A-634984, in book K-3392 at page 23, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 6. All that part of the 5 foot utility easement dedicated by the plat of Wornall Plaza recorded on May 11, 1939, and located on Lot 1, Wornall Plaza, Second Plat, a subdivision in Kansas City, Jackson County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 7. That the utility easement which was reserved by Kansas City, Missouri, over vacated alley in book 93, page 692 and 693, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 8. All that part of the sewer easement previously accepted by Kansas City, Missouri Ordinance No. 37984, passed December 6, 1920, located over the north 6 feet of Lots 85, 86, 87, 88, 89 and 90, of Union Terminal Addition, as established by the instrument filed as Document No. A-1314, in book B-2166 at page 93, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 9. That the sanitary sewer easement previously retained by Ordinance No. 37240, passed March 22, 1920, recorded as Document No. 1402201 in book B-2050, at page 516, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 10. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Independence, for Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
