ORDINANCE NO. 020074

 

Accepting a Quit Claim Deed from the State of Missouri, acting by and through the Missouri Highways and Transportation Commission, for a portion of relocated Missouri State Route 150 and directing the City Clerk to record a copy of this ordinance in the office of the Jackson County, Missouri Department of Records.

 

WHEREAS, the Council finds that it entered into a Cooperative Agreement for Public Improvement and relocation of Missouri State Route 150 from the Missouri-Kansas state line to Holmes Road with the Missouri Highways and Transportation Commission on November 16, 1992, as authorized by Ordinance No. 921209, passed November 5, 1992, wherein the City agrees to share the cost and to be responsible for the acquisition of certain lands which must be acquired in connection with the making of improvements to the relocated Missouri State Route 150 as provided for and authorized herein; and

 

WHEREAS, the Council finds that the State of Missouri, acting by and through the Missouri Highways and Transportation Commission did acquire one tract of land which was required to be deeded to the City of Kansas City as part of said Cooperative Agreement; and

 

WHEREAS, the Council finds that a Quit Claim Deed was given to the City of Kansas City dated December 29, 1997 and duly recorded in the office of the Director of Records for Jackson County, Missouri, and that deed has not been accepted by the Council of the City of Kansas City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Quit Claim Deed conveying property to the City of Kansas City, Missouri, for public use purposes as part of the relocation of Missouri State Route 150, and recorded in the office of the Jackson County Department of Records as Instrument No. K982923 recorded in Book K3128, page 747, is hereby accepted and legally described as follows:

 

This Quit Claim Deed lies within the Southwest One-Quarter of the Southwest One-Quarter of Section 29, Township 29 North, Range 47 West, except the west 400 feet, in Kansas City, Jackson County, Missouri.

 


A copy of the Quit Claim Deed is attached hereto and made a part of this ordinance.

 

Section 2. That the City Clerk is hereby directed to record a copy of this ordinance in the office of the Director of Records for Jackson County, Missouri, as evidence of the acceptance of the herein described property by the City for public use purposes.
