ORDINANCE NO. 140188

 

Authorizing the City Manager to execute a fourth amendment of a contract with the Neighborhood Housing Services of Kansas City to enlarge the term of the contract and to further the EnergyWorks KC program.

 

WHEREAS, the City was one of 41 entities nationwide selected by the Department of Energy (“DOE”) to be a recipient of a Better Buildings Program grant and the City has negotiated a revised scope of work consistent with a grant award in the amount of $20,000,000.00 in order to implement the EnergyWorks KC (“EWKC”) program; and

 

WHEREAS, pursuant to Ordinance No. 110896, the City entered into Contract No. EECBG-ARRA-OEQ-8 (the “Contract”) with Neighborhood Housing Services (“NHS”) to establish an interest rate buy-down fund program as a tool for the EWKC program; and

 

WHEREAS, the Contract has been amended on three previous occasions to account for extensions related to the grant award; and

 

WHEREAS, DOE extended the City’s grant term to March 30, 2014; and

 

WHEREAS, DOE guidelines for use of interest rate buy-down funds beyond the end of that grant term require that the funds be used for the original purpose of the award; and

 

WHEREAS, the City desires to amend the Contract with NHS to continue the use of the grant funds as an interest rate buy-down fund for energy efficiency improvements through April 30, 2015; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1.  That the City Manager is hereby authorized to execute a fourth amendment to the Contract with the NHS to enlarge the term of the Contract and to further the EWKC program.  A copy of the fourth amendment, approved in substantial form, is on file with the Office of Environmental Quality.
