ORDINANCE NO. 150159

 

Rezoning an area of approximately 16 acres generally located south of E. Independence Avenue, north of E. 12th Street, west of the Blue River and east of the BNSF and Union Pacific railroads, from District M1-5 to UR, and approving a preliminary development plan which also serves as a preliminary plat. (14456-UR).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0997, rezoning an area of approximately 16 acres generally located south of E. Independence Avenue, north of E. 12th Street, west of the Blue River and east of the BNSF and Union Pacific railroads, from District M1-5 (Manufacturing 1 (dash 5)) to UR (Urban Redevelopment), said section to read as follows:

 

Section 88-20A0997. That an area legally described as:

 

TRACT 1: All of Blocks 1, 2 and 3, Reading, a subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, recorded May 23, 1888, as Document No. 80050 in Plat Book 8 at Page 50 and all of 6th, 7th, and 8th Sstreets and the east and west alleys dedicated by the recorded plat, and vacated by Ordinance No. 9771 by the City of Kansas City, Missouri, recorded February 20, 1946, as Document No. A-829819, in Book B-4001 at Page 616.

 

TRACT 2: All of Lot 1 in George T. Moore’s First Addition, a subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof:

 

EXCEPT that part thereof described as follows: Beginning at the Northwest corner of said Lot 1; thence in a Southeasterly direction along the Westerly line of said Lot 1, 300 feet to a point; thence in a Northeasterly direction along a line which makes a Northeasterly angle with the last described course of 78 degrees 30 minutes, 330 feet, more or less, to the left bank of the Big Blue River; thence in a Northerly direction along the left bank of said river 170 feet, more or less, to the Northeast corner of said Lot 1; thence West along the North line of said Lot 1, 380 feet, more or less, to the point of beginning;

 

ALSO EXCEPT the easement for railroad right-of-way condemned by the Missouri Pacific Railroad Company, in Case No. 260105 in the Circuit Court of Jackson County, Missouri, at Kansas City over the following described tract of land: Beginning at a point in the East line of said Lot 1, 297.92 feet North of the Southeast corner thereof; thence Southwesterly along a line which makes a Southwest angle of 33 degrees 53 minutes with the East line of said Lot 1, a distance of 121.98 feet; thence continuing Southwesterly along a curve to the left from the last described course as a tangent, having a radius of 533.69 feet, a distance of 214.06 feet to a point in the South line of said Lot l ; thence West along the South line of said Lot 1, a distance of 81.27 feet; thence Northeasterly along a curve to the right, said curve having a radius of 613.69 feet, and being 80 feet Westerly of and parallel with the aforesaid described curve a distance of 261.49 feet; thence Northeasterly along a line tangent to the last described curve and along a line 80 feet Westerly of and parallel with the first described course, a distance of 241.10 feet to a point in the East line of said Lot 1; thence South along the East line of said Lot 1, a distance of 143.50 feet to the point of beginning.

 

TRACT 3: All that part of Lot 1, lying northerly of a straight line forming a Northeasterly angle of 78 degrees 30 minutes with the Westerly line of Lot 1 aforesaid and drawn through a point in said Westerly line which is 300 feet Southeasterly from the Northwest corner of said lot, in George T. Moore’s First Addition to Kansas City, Missouri, a subdivision in said Kansas City, according to the recorded plat thereof, also described as follows: Beginning at the Northwest corner of said Lot 1; thence in a Southeasterly direction along the Westerly line of said Lot 1, 300 feet to a point; thence in a Northeasterly direction along a line which makes a northeasterly angle with the last described course of 78 degrees 30 minutes, 330 feet, more or less, to the left bank of the Big Blue River; thence in a Northerly direction along the left bank of said river 170 feet, more or less, to the Northeast corner of said Lot 1; thence West along the North line of said Lot 1, 380 feet, more or less, to the point of beginning.

 

Tract 4: That part of Lot 1 in George T. TRACT 5: All of Lot Two (2) (sometimes called Block Two (2) of George T. Moore’s First Addition to Kansas City, Missouri, an addition or subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, except that part acquired for railroad purposes by Missouri Pacific Railroad Company in the case of Missouri Pacific Railroad Company v. Clara Meyer, et al, in the Circuit Court of Jackson County, Missouri, at Kansas City, No. 260105 over, across and upon the following described portion of said Lot Two (2): Beginning at the intersection of the North line of said Lot 2 with the Easterly line of the present right of way of Missouri Pacific Railroad; thence running Southeasterly along said line of said right of way 252.25 feet; thence North 244.67 feet to the North line of said Lot 2 at a point 61.38 feet East of the point of beginning; thence West along said North line 61.38 feet to the Point of Beginning.

 

TRACT 6: A tract of land described as follows: Beginning at the intersection of the North line of said Lot 2, George T. Moore’s First Addition, a subdivision in Kansas City, Jackson County, Missouri with the Easterly line of the present right of way of Missouri Pacific Railroad; thence running Southeastwardly along said line of said right of way 252.25 feet; thence North 244.67 feet to the North line of said Lot 2 at a point 61.38 feet East of the point of beginning; thence West along said North line 61.38 feet to the Point of Beginning.

 

TRACT 7: All that part of 7th Street from Winchester Avenue to the Big Blue River, vacated under Ordinance No. 29910, by the City of Kansas City, Missouri, recorded October 9, 1905, as Document No. 544079, in Book 977 at Page 383.

 

TRACT 8: All that part of Independence Avenue from the East line of the Missouri Pacific Right-of-way on the West to the West line of Manchester Avenue on the East, vacated under Ordinance No. 10067, by the City of Kansas City, Missouri, and recorded June 27, 1946, as Document No. A-847399, in Book B-4009 at Page 638.

 

TRACT 9: All that part of the East 34 feet of Reading Avenue, measured at right angles to the Easterly line of said Reading Avenue, from the South line of lndependence Avenue on the North to the South line of 8th Street on the South, vacated under Ordinance No. 10068, by the City of Kansas City, Missouri and recorded June 27, 1946, as Document No. A-847401, in Book B-4009 at Page 636.

 

Tract 10: All that part of 10th Street from the east line of the Missouri Pacific Railroad Company’s main line right-of-way to the west line of Corington Avenue vacated under Ordinance No. 14993, by the City of Kansas City, Missouri and recorded November 19, 1951, as Document No. B-39158, in Book B-4456 at Page 405.

 

TRACT 11: All that part of Corrington Avenue from the North line of the plat of George T. Moore’s First Addition, to the North line of 12th Street, vacated under Ordinance No. 25439, by the City of Kansas City, Missouri, and recorded October 13, 1960, as Document No. B-358046, in Book B-5348 at Page 397.

 

TRACT 12: A nonexclusive perpetual right and easement for ingress and egress by all manner of vehicular and pedestrian traffic over vacated Corrington Avenue from its intersection with 12th Street in Kansas City, Jackson County, Missouri, North to the Big Blue River as reserved to Armco Inc., an Ohio corporation, its successor and assigns by the Special Warranty Deed and Reservation of Easement dated November 7, 1986, recorded December 31, 1986, as Document No. K-752284, in Book K-1626 at Page 519 and in the instrument recorded December 31, 1986, as Document No. I-741812, in Book I-1627 at Page 356.

 

is hereby rezoned from District M1-5 (Manufacturing 1 (dash 5)) to UR (Urban Redevelopment), all as shown outlined on a map marked Section 88-20A0997, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved. A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
