ORDINANCE NO. 050199

 

Approving the preliminary plat of The Chalfonte Condominiums on a 0.23 acre tract of land generally located on the north side of Armour Boulevard approximately 155 feet east of Troost Avenue (SD 1122)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of The Chalfonte Condominiums on a 0.23 acre tract of land generally located on the north side of Armour Boulevard approximately 155 feet east of Troost Avenue, and more specifically described as follows:

 

Lot 24 and Lot 26, except the North 40 feet of the East 90 feet and except the North 28.3 feet of the West 40 feet of Lot 26, except that part in street, Arcade Place, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof Recorded in Book K3318 on Page 2386.

 

Easement legal description: Part of Lot 26, Arcade Place, a Subdivision in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the Southeast Corner of Lot 26; thence NO E along the East Line of Lot 26, 10.00 feet to the Point of Beginning; thence N89 5705 W, 90.00 feet; thence NO E, 11.70 feet; thence N89 57 05 W, 40.00 feet to the West line of Lot 26, thence NO E along said West Line, 3,30 feet; thence S89 57 05E, 130.00 feet to the East Line of Lot 26; thence SO W along said East Line, 15.00 feet to the Point of Beginning. Recorded on Document No. 2002 K0078061. Containing 1,482 square feet more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Department of Public Works in accordance with Chapters 56 and 64 of the Code, prior to recording of the plat.

 

3. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas and private open space.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
