Approving a Community Unit Project on an approximately 184.12 acre tract of land generally located on the south side of Missouri Highway 291 at N. Eastern Avenue. (11931-CUP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 184.12 acre tract of land generally located on the south side of Missouri Highway 291 at N. Eastern Avenue, and more specifically described as follows:

 

All that part of the Southeast Quarter of Section 21, all that part of the Southwest Quarter of Section 22, and all that part of the Northwest Quarter of Section 27, all in Township 52, Range 32, Kansas City, Clay County, Missouri, being described as follows: Beginning at the southeast corner of the Southeast Quarter of said Section 21; thence South 8950'16" West, along the south line of said Southeast Quarter, 685.00 feet; thence North 028'55" West, 806.00 feet; thence South 8950'16" West, 1537.99 feet to a point on the easterly line of Reinking Road, as now established; thence North 028'55" West, along said easterly line, 1355.77 feet; thence North 8958'00" East, 654.81 feet; thence North 028'55" West, 434.00 feet to a point on the southerly right of way line of Missouri State Highway No. 291, as now established; thence North 8958'00" East, along said southerly right of way line, 137.88 feet; thence easterly, along said southerly right of way line, on a curve to the right, tangent to t he last described course, having a radius of 1392.40 feet, an arc distance of 916.59 feet; thence South 5219'00" East, along said southerly right of way line, 678.57 feet; thence South 3741'00" West, 23.27 feet; thence southerly, along a curve to the left, tangent to the last described course, having a radius of 700.00 feet, an arc distance of 815.77 feet; thence southerly, along a curve to the right, having a common tangent with the last described course, a radius of 727.38 feet, an arc distance of 432.88 feet; thence South 028'13" East, 204.09 feet; thence North 5714'12" East, 248.24 feet; thence North 8926'47" East, 222.86 feet; thence North 2311'09" East, 212.15 feet; thence North 5714'12" East, 51.20 feet; thence North 5714'12" East, 474.12 feet to a point on the aforementioned southerly right of way line; thence southeasterly, along said southerly right of way line, on a curve to the left having an initial tangent bearing of South 5302'51" East, a radius of 22965.74 feet, an arc distance of 248.13 feet; thence South 5340'00" East, along said southerly right of way line, 177.80 feet; thence South 3620'00" West, along said southerly right of way line, 10.00 feet; thence South 5340'00" East, along said southerly right of way line, 1380.00 feet; thence North 3620'00" East, along said southerly right of way line, 10.00 feet; thence South 5340'00" East, along said southerly right of way line, 291.69 feet to a point on the east line of the Northwest Quarter of said Section 27; thence South 015'13" East, along said east line, 916.09 feet; thence North 8943'10" West, along the south line of the north 63.25 acres of said Northwest Quarter, 2637.41 feet to a point on the west line of said Northwest Quarter; thence North 024'55" West, along said west line, 1044.14 feet to the true point of beginning. Containing 184.12 acres, more or less.

 


is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for N. Reinking Road as required by the Department of Public Works so as to provide a total of 30 feet of right of way as measured from the centerline of N. Reinking Road.

 

6. That the developer improve the east half of N. Reinking Road to collector street standards as required by the Department of Public Works.

 

7. That the developer dedicate additional right of way for Missouri Highway 291 as required by the Department of Public Works so as to provide a total of 60 feet of right of way as measured from the centerline of Missouri Highway 291.

 

8. That the developer dedicate right of way for N. Eastern Avenue as required by the Department of Public Works so as to provide a total of 80 feet of right of way for N. Eastern Avenue.

 

9. That the developer improve the west half and the east half of N. Eastern Avenue to secondary arterial street standards as required by the Department of Public Works, including construction of a center left turn lane to serve the two commercial driveways on the east side and the northernmost collector street on the west side.

 

10. That the developer submit covenants, conditions and restrictions with the final plat to the Law Department for approval for the maintenance of the private open space and the detention areas.

 

11. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

12. That the developer extend water mains as required by the Water Services Department.

 

13. That the developer submit a street tree planting plan as a part of the final plat and secure the approval of the City Forester for street trees planted on right of way. The plan shall include size, type, species and placement of trees and a copy shall be submitted to the Department of City Development.

 

14. That the developer submit a street name sign plan to the Street Naming Committee for approval.

 

15. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

16. That the developer extend and construct sanitary sewers as required by the Department of Public Works.

 

17. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

18. That the developer contribute $26,202.05 in lieu of parkland dedication for 510 units for the remainder of the parkland requirement in satisfaction of Section 66-128 of the Subdivision Regulations.

 

19. That the developer construct a westbound left turn lane on Missouri Highway 291 to Missouri Highway and Transportation Department standards at such time as the east public street as shown on the preliminary plan is constructed to access Missouri Highway 291.

 

20. That the developer construct intersection improvements to Missouri Highway 291 and N. Eastern Avenue to Missouri Highway and Transportation Department standards at such time as N. Eastern Avenue is constructed to access Missouri Highway 291. The intersection improvements will include the construction of eastbound and westbound left turn lanes on Missouri Highway 291, construction of northbound and southbound left turn lanes on N. Eastern Avenue, and the installation of traffic signals.

 

21. That the developer enter into a Cooperative Agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute $20,000.00 for the improvement of N. Eastern Avenue, north of Missouri Highway 291, prior to approval of the first final plat.

 

22. That the developer enter into a Cooperative Agreement with the City as required by the Department of Public Works prior to the approval of the first final plat whereby the developer agrees to accelerate its construction of an eastbound left turn lane on Missouri Highway 291 at N. Eastern Avenue to Phase 1 as shown on the preliminary plan provided that the City participates in the cost of construction in an amount not to exceed $100,000.00 or 50% of the cost of such construction, whichever is less.

 

23. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 971544, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
