ORDINANCE NO. 941264

 

Approving an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on a 10.27 acre tract of land generally located at the southwest corner of 103rd Street and Summit Street. (10179-P-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on a 10.27 acre tract of land generally located at the southwest corner of 103rd Street and Summit Street, and more specifically described as follows:

 

Lot 1, SUPERIOR DATSUN-BUICK 1ST PLAT, Lot 1, SUPERIOR DATSUN-BUICK 2ND PLAT, Lot 2, SUPERIOR DATSUN-BUICK 3RD PLAT, Lot 1, SUPERIOR DATSUN-BUICK 4TH PLAT, Lot 1, SUPERIOR HYUNDAI, all subdivisions in Kansas City, Jackson County, Missouri, according to the recorded plats thereof.

 

is hereby approved, subject to the following conditions:

 

1. That the developer dedicate additional right of way as required for 103rd Street so as to insure 40 feet of

right of way as measured from the centerline of 103rd

Street; provided that the developer may enter into a

deferral agreement for the dedication of right of way

until all necessary right of way for 103rd Street has

been obtained and the City is prepared to make street

improvements.

 

2. That the developer contribute money for off-site transportation improvements in the I-435 Study Area at

the rate of $1.15 per square foot for additional floor

area; such contribution to be paid at time of building

permit.

 

3. That the developer extend water mains as required by the Water Department.

 

4. That the developer provide for fire protection as required by the Fire Department.

 

5. That the developer submit a final plan for each stage to the City Plan Commission for approval. The final plans

shall include: site plan; dimension plan; grading plan;

landscape plan; and signage plans.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 941264, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
