Ordinance 900807

 

Submitting to the qualified electors of Kansas City an amendment to Section 84 of the Charter of Kansas City, removing from the Commissioner of Revenue's exclusive responsibilities the enforcement of ordinances licensing persons obtaining contractor licenses pursuant to the building code; and recognizing an emergency.

WHEREAS, Section 84 of the Charter of Kansas City now provides that the commissioner of revenue "shall be charged with the enforcement of all ordinances relating" to licenses; and

 

WHEREAS, the regulation of the technical work of electrical contractors, fire protection contractors, gas fired appliance contractors, heating and ventilating contractors, pipe fitting contractors, refrigeration contractors, and plumbing contractors, rests with the Director of Codes of Administration; and

 

WHEREAS, all persons properly involved in the investigation of such contractors are technically trained persons now working in the Codes Administration Department; and

 

WHEREAS, removing the ultimate responsibility for the regulation of building code contractors from the commissioner of revenue, thus enabling the efficient regulation of building code contractors to be placed in the Director of Codes Administration; and

 

WHEREAS, a municipal election will be held February 26, 1991; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That there shall be submitted to the electors of Kansas City, at the next election to be held in Kansas City, not less than 60 days after passage of this ordinance, an amendment to Section 84 of the Charter of Kansas City, adopted February 24, 1925, as amended, which proposal shall read as follows:

 

CHARTER AMENDMENT OF KANSAS CITY, MISSOURI, REMOVING FROM THE COMMISSIONER OF REVENUE'S EXCLUSIVE RESPONSIBILITIES THE ENFORCEMENT OF ORDINANCES LICENSING PERSONS OBTAINING CONTRACTOR LICENSES PURSUANT TO THE BUILDING CODE.

 

BE IT ADOPTED BY THE PEOPLE OF KANSAS CITY:

 

(1) That Article IV of the Charter of Kansas City,

adopted February 24 1925, as amended, is further amended by amending Section 84 to read as follows:

 


Section 84. Division of Revenue.

 

There shall be in the department of finance, a

division of revenue which shall be under the

supervision of a commissioner of revenue, who shall

be appointed by the director of finance.

 

The commissioner of revenue shall have charge

of the issuance and revocation of all licenses and

shall be charged with the enforcement of all

ordinances relating thereto, except those licenses

issued pursuant to the building code. The

commissioner of revenue shall supervise the

collection of any tax measured by earnings and

shall be charged with the enforcement of ordinances

relating thereto.

 

The commissioner of revenue shall also perform

such other duties as may be required by this

charter or ordinance.

 

(2) This section shall take effect immediately upon

approval by the electors.

 

Section 2. That the ballot title for this proposition shall be as follows:

Amending Section 84, Charter of Kansas City, by removing from the Commissioner of Revenue's exclusive responsi- bilities the enforcement of ordinances licensing persons obtaining contractor licenses pursuant to the building code, thus allowing regulation by other officials.

The voter who desires to vote in favor of this proposition shall place an "" in the box opposite "Yes". The voter who desires to vote against this proposition shall place an "" in the box opposite "No".

 

Section 3. That the City Clerk shall deliver to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Clerk of the County Commission of Platte County, and to the Clerk of the County Commission of Cass County, each a certified copy of this ordinance which shall be the authority for the election authorities to conduct the election, provide the ballot labels and ballots therefore, give notice of the election according to law, and to certify the results of the election.

 

Section 4. That this ordinance, providing for the submission of a proposal to the people is recognized as an emergency measure within the provisions of Section 15, Charter of the City of Kansas City, and shall take effect immediately.
