ORDINANCE NO. 010672

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 6.56 acre tract of land generally located at the northwest corner of Missouri Highway 152 and N. Oak Trafficway. (12009-CP-7)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 6.56 acre tract of land generally located at the northwest corner of Missouri Highway 152 and N. Oak Trafficway, and more specifically described as follows:

 

A tract of land in the East One Half of the Northwest Quarter of Section 2, Township 51, Range 33, Kansas City, Clay County, Missouri, being described as follows: Commencing at a point on the west line of the East One Half of the Northwest Quarter of said Section 2, said point being 473.98 feet north of the southwest corner thereof; thence South 89E33'33" East, 828.16 feet to the true point of beginning of the tract to be herein described; thence North 17E03'14" West, 206.96 feet; thence North 01E03'35" East, 354.38 feet; thence northeasterly on a curve to the left, having an initial tangent bearing of North 68E36'13" East, a radius of 350.00 feet, an arc distance of 61.44 feet; thence North 60E56'23" East, 231.92 feet; thence northeasterly on a curve to the right, tangent to the last described course, having a radius of 254.00 feet, an arc distance of 130.64 feet; thence South 89E35'31" East, 148.13 feet to its intersection with the centerline of Missouri State Highway No. 169; thence South 0E21'52" West, along said centerline, 217.48 feet; thence South 89E49'12" West, 67.73 feet to a point on the westerly line of N. Oak Trafficway, as now exists; thence South 10E00'45" West, along said westerly line, 452.16 feet to its intersection with the northerly right of way line of Missouri Route 152, as now exists; thence South 79E39'08" West, along said northerly right of way line, 334.55 feet to the true point of beginning. Containing 6.56 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.


4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to any construction beyond foundations.

 

6. That the developer extend and construct sanitary sewers as required by the Department of Public Works.

 

7. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

8. That the developer construct a five foot sidewalk on the east and west sides of the north/south internal driveway as shown on the preliminary plan as required by the Department of City Development.

 

9. That the developer receive approval from the Board of Zoning Adjustment for a variance to the setback required pursuant to Section 80-112(b)(2).

 

10. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage, site lighting and noise control.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 010672, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
