ORDINANCE NO. 050779

 

Approving an amendment to a previously approved preliminary plan in District R-2b on approximately 23.2 acres generally located on the west side of Pryor Road about a quarter-mile north of Bannister Road (9619-CUP-7)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District R-2b (Two-Family Dwellings) on approximately 23.2 acre tract of land generally located on the west side of Pryor Road about a quarter-mile north of Bannister Road, and more specifically described as follows:

 

A tract of land in the Northeast Quarter of the Southeast Quarter and in the Southeast Quarter of the Northeast Quarter, all in Section 26, Township 48, Range 32, in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the southeast corner of the Southeast Quarter of said Section 26; thence North 03 degrees 26 minutes 41 seconds East (Deed = North 03 degrees 34 minutes 00 seconds East) along the east line of said Quarter Section, a distance of 1942.16 feet; thence North 85 degrees 55 minutes 23 seconds West (Deed = North 86 degrees 26 minutes 00 seconds West), a distance of 209.69 feet (Deed = 215.59 feet) to the point of beginning, said point being 70 feet right of p.t. station 28+30.20 of U.S. Highway No. 350 outer road; thence North 82 degrees 17 minutes 24 seconds West (Deed = North 81 degrees 55 minutes 10 seconds West), a distance of 638.20 feet (Deed = 638.03 feet); thence North 34 degrees 32 minutes 00 seconds West (Deed = North 34 degrees 23 minutes 51 seconds West), a distance of 835.61 feet (Deed = 835.40 feet) to the southwest corner of the Southeast Quarter of the Northeast Quarter of Section 26, Township 48, Range 32; thence North 03 degrees 10 minutes 26 seconds East (Deed = North 03 degrees 25 minutes 39 seconds East) along the west line of said Quarter Quarter Section, a distance of 789.91 feet (Deed = 788.23 feet) to a point on the southerly right-of-way of U.S. Highway No. 350; thence South 57 degrees 36 minutes 34 seconds East (Deed = South 57 degrees 25 minutes 10 seconds East), parallel with the survey centerline of said highway, a distance of 61.15 feet (Deed = 60.41 feet) to a point 290 feet opposite centerline station 472+16.5 (350 Highway), said point being 90 feet right of centerline station 8+07.30 (outer road); thence continuing along said highway right-of-way South 61 degrees 26 minutes 41 seconds East (Deed = South 61 degrees 15 minutes 17 seconds East), a distance of 257.92 feet to a point 260 feet right of centerline station 475+00 (350 Highway); thence continuing along said highway right-of-way in a southeasterly direction along a curve to the right, having an initial tangent bearing of South 51 degrees 56 minutes 22 seconds East (Deed = South 51 degrees 44 minutes 58 seconds East), a radius of 2604.79 feet, a central angle of 18 degrees 43 minutes 12 seconds, an arc length of 851.05 feet to a point 260 feet right of centerline station 484+36 (350 Highway), said point also being 81 feet right of centerline station 19+40.20 (outer road); thence continuing along said highway right-of-way South 32 degrees 41 minutes 55 seconds East (Deed = South 32 degrees 30 minutes 31 seconds East), a distance of 242.41 feet to a point 70 feet right of centerline station 22+00 (outer road); thence continuing along said highway right-of-way in a southwesterly direction along a curve to the right, having an initial tangent bearing of South 23 degrees 37 minutes 22 seconds East (Deed = South 23 degrees 25 minutes 46 seconds East), a radius of 1075.92 feet, a central angle of 31 degrees 30 minutes 37 seconds, an arc length of 591.70 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer construct a left turn lane with taper on southbound Pryor Road at Bannister Road per the traffic study, that left turn lanes with tapers be constructed on Pryor Road at each driveway entrance per the traffic study, and that Pryor Road between those improvements be widened to a minimum of 32 feet in paved width including sidewalks on the west side prior to the issuance of any certificates of occupancy for any buildings within the development plan.

 

3. That prior to the issuance of any certificates of occupancy for any

building within the development plan, the developer construct and maintain an emergency access to Bannister Road via the emergency ingress/egress easement in this plan and Wedgewood Pointe 3rd Plat which:

 

(a) meets the requirements of the Fire Department and Public Works Department,

 

(b) is constructed of a chip and seal material capable of supporting emergency equipment,

 

(c) is not open for general public use, and

 

(d) will be gated with a breakaway design approved by the Fire Department upon a determination by the Director of Public Works that gating is required in the interest of public safety.


4. That the developer submit a macro/micro storm drainage study to Development Services for approval for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services.

 

5. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

6. That the developer obtain a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed buildings and determine adequacy as required by Development Services.

 

8. That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer shall be responsible for all costs associated with subordination activities.

 

9. That the developer secure the approval of the Missouri Department of Transportation for any work within State right of way.

10. That adequate sight distance be provided for each street connection to Pryor Road as required by Development Services.

 

11. That the developer design and construct all interior streets to City standards as required by Development Services, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

12. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

13. That any relocated streetlights be integrated into the existing street light system as required by Development Services and the Missouri Department of Transportation along State frontages.

 

14. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

15. That the developer extend water mains and grant easements as required by the Water Services Department.


16. That the developer contribute $3426.79 in lieu of parkland dedication for 192 units (192 units X 2.0 X .006 (less credit for 1.96 acres of private open space) X $9,961.61 = $3,426.79) in satisfaction of Section 66-128 of the Subdivision Regulations, with credit for any approved private open space.

 

17. That the developer receive approval of a Certificate of Survey or a lot split prior to the sale of individual units.

 

18. That a final certificate of occupancy for the pool/cabana be issued prior to a final certificate of occupancy for the last of the residential structures in Phase 1.

19. That the developer submit a final plan to the City Plan Commission for each phase for approval including the pool/cabana in Phase 1, and including detailed information on landscaping (including canopy shade trees a maximum of 50 feet on center along the Pryor Road frontage, an average of 40 feet on center along interior streets, ornamental trees between driveways, a minimum of 34 canopy shade trees in the 150 foot buffer and at least one canopy shade tree per unit in other rear and side yards) and building elevations.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
