COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980635

 

Approving a $340,875.00 contract with Waste Management Industrial Services for Contract No. 632 Emergency Service, Biosolids Removal, Dewatering and Disposal at the Blue River Wastewater Treatment Plant; authorizing a change order reducing the actual contract amount by $143,629.90 to reflect the final costs of the work; authorizing expenditure of funds in the amount of $231,332.10; and recognizing an emergency.

 

WHEREAS, it is necessary to remove, dewater and dispose of biosolids at the Blue River Wastewater Treatment to ensure regulator compliance; and

 

WHEREAS, this condition presents an immediate threat to public property, health and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That a $340,875.00 contract between Kansas City, Missouri, through its Director of Water Services, and Waste Management Industrial Services for emergency service, biosolids removal, dewatering and disposal at the Blue River Wastewater Treatment Plant, is hereby approved and confirmed.

 

Section 2. That the Director of Water Services is hereby authorized to execute a Change Order No. 1 for Contract No. 632, concurrent with execution of the contract, reducing the contract amount by $143,629.90 to reflect the final costs of the emergency work.

 

Section 3. That the Director of Water Services is hereby authorized to expend up to the sum of $231,332.10 from funds previously appropriated to the following account to satisfy the cost of this contract including contingencies.

 

99-811-080-7726-T Construction Division $231,332.10

 

Section 4. This ordinance is declared to be an emergency measure within the provisions of Section 15, Article II of the Charter of Kansas City because it is for the immediate preservation of public property, health and safety and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
