RESOLUTION NO. 021247
Amending the South Central
Area Plan in an area generally bounded by Oak Street on the west, Prospect
Avenue on the east, 59th Street on the north and 63rd Street on the south, by
recommending commercial, low-medium density residential,
office/institutional, mixed-use/residential/office/institutional,
mixed-use residential/commercial/office/ institutional and park or open
space instead of recreation and open space, light industrial, public-semi
public, low density residential, medium density residential, office
commercial and retail commercial uses. (249-S-6)
WHEREAS, on March
21, 1980, the City Council by adoption of Resolution No. 51319 adopted the
South Central Area Plan being the plan for development and redevelopment of
that area bounded by Volker/47th Street on the north, 63rd Street on the south,
Prospect Avenue on the east and Oak Street on the west; and
WHEREAS, said
South Central Area Plan was amended on June 18, 1989, through the adoption of
Committee Substitute for Resolution No. 63221; was again amended on November
30, 1989, through the adoption of Resolution No. 64742; was amended on November
6, 1997, through the adoption of Resolution No. 971077; was amended on February
11, 1998, through the adoption of Resolution No. 981498; and amended on March
18, 1999, through the adoption of Resolution No. 990137; and was further
amended on July 12, 2001, through the adoption of Resolution No. 010947; and
WHEREAS, after
further review by the City Development Department it has been deemed
appropriate to amend the South Central Area Plan as it affects that area
generally bounded by Oak Street on the west, Prospect Avenue on the east, 59th
Street on the north and 63rd Street on the south, to modify the Proposed Land
Use Plan and Map by recommending commercial, low-medium density
residential, office/institutional,
mixed-use/residential/office/institutional, mixed-use
residential/commercial/office/institutional and park or open space instead
of recreation and open space, light industrial, public-semi public, low
density residential, medium density residential, office commercial and
retail commercial uses; and
WHEREAS, public
notice of a hearing before the City Plan Commission was published on September
2, 2002; and
WHEREAS, the City
Plan Commission considered such amendment to the Proposed Land Use Plan and Map
on September 17, 2002; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on September 17, 2002, recommend approval of the proposed
amendment to the South Central Area Plan; NOW, THEREFORE,
BE IT RESOLVED BY
THE COUNCIL OF KANSAS CITY:
Section A. That
the South Central Area Plan is hereby amended for that area generally bounded
by Oak Street on the west, Prospect Avenue on the east, 59th Street on the
north and 63rd Street on the south, to modify the Proposed Land Use Plan and
Map by recommending commercial, low-medium density residential,
office/institutional, mixed-use/residential/ office/institutional,
mixed-use residential/commercial/office/institutional and park or open
space instead of recreation and open space, light industrial, public-semi
public, low density residential, medium density residential, office
commercial and retail commercial uses. A copy of said amendment to the
South Central Area Plan is attached hereto as Exhibit A and incorporated herein
by reference.
Section B. That
the amendment to the South Central Area Plan is consistent and complies with
the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee
Substitute for Resolution No. 971268, and is adopted as a supplement to the
FOCUS Kansas City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
