ORDINANCE NO. 961284

 

Approving an amendment to a previously approved development plan in District GP-1 (General Industry) on approximately a 4.16 acre tract of land generally located approximately 820 feet south of the intersection of N.W. 97th Terrace and N. Shannon Avenue to delete an approximately 1.6 acre tract of land from said development plan. (6777-GP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-1 (General Industry) on approximately a 4.16 acre tract of land generally located approximately 820 feet south of the intersection of N.W. 97th Terrace and N. Shannon Avenue, which redefines the district boundaries to delete an approximately 1.6 acre tract of land, generally described as follows:

 

A tract of land in Lot 1, Block 4, Platte Industrial Park - Fourth Plat, District 4, a subdivision of land in the Southwest Quarter of Section 36, Township 52, Range 34, and the Northwest Quarter of Section 1, Township 51, Range 34, all in Kansas City, Platte County, Missouri, being bounded and described as follows: Commencing at the southeast corner of the Southwest Quarter of said Section 36; thence North 0 32'22" East, along the east line of said Southwest Quarter, 165.57 feet; thence North 89 27'38" West, 20.00 feet to the true point of beginning of the tract to be herein described; thence North 89 26'48" West, 365.16 feet to the east right of way line of N. Shannon Avenue, as now established; thence North 0 12'38" West, along said east right of way line, 190.71 feet; thence North 89 47'21" East, 367.68 feet to the west right of way line of N. Congress Avenue, as now established; thence South 0 32'22" West (Plat - South 0 33'12" West), along said west right of way line, 195.60 feet to the true point of beginning. Containing 1.62 acres, more or less;

 

Said revised legal description for the remaining 2.62 acre tract of land for said development, to read as follows:

 

A tract of land in Lot 1, Block 4, Platte Industrial Park - Fourth Plat, District 4, a subdivision of land in the Southwest Quarter of Section 36, Township 52, Range 34, and the Northwest Quarter of Section 1, Township 51, Range 34, all in Kansas City, Platte County, Missouri, being described as follows: Commencing at the southeast corner of the Southwest Quarter of said Section 36; thence South 89 46'21" West, along the south line of said Southwest Quarter, 20.00 feet to the true point of beginning of the tract to be herein described; thence continuing South 89 46'21" West, (Plat - South 89 35'46" West), along said south line, 43.83 feet to the northeast corner of said Northwest Quarter; thence South 0 30'47" West (Plat - South 0 29'36" West ), along the east line of said Northwest Quarter, 115.00 feet; thence South 22 49'13" West (Plat - South 22 48'10" West), 57.96 feet (Plat - 57.94 feet) to the southeast corner of said Lot 1; thence South 89 47'21" West, along the south line of said Lot 1, 295.00 feet to the easterly right of way line of N. Shannon Avenue, as now established; thence North 0 12'38" West, along said east right of way line, 339.03 feet; thence South 89 26'48" East, 365.16 feet to the west right of way line of N. Congress Avenue, as now established; thence South 0 32'22" West (Plat - South 0 33'12" West), along said west right of way line, 165.83 feet to the true point of beginning. Containing 2.62 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer construct improvements as required by the City

Engineer's Office.

 

3. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

4. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

5. That the developer design and install streetlights along N. Shannon Avenue as required by the Department of Public Works.

 

6. That the developer comply with the KCI Airport Height Zoning restrictions.

 

7. That the developer grant a Noise and Aviation Easement to the City.

 

8. That the developer provide for cross-access easements on the final plats for each phase.

 

9. That the developer construct sidewalks along the east side of N. Shannon Avenue.

 

10. That the developer improve the west half of N. Congress Avenue to arterial street standards as required by the Department of Public Works.

 

11. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

12. That the developer extend water mains as required by the Water Services Department.

 

13. That the developer extend sanitary sewers as required by the Department of Public Works.

 

14. That the developer provide for fire protection as required by the Fire Department.

 

15. That the developer submit a GP District signage plan showing locations of all signage and providing elevation drawings of wall signage upon the wall, monument signage

(including the base and information on material), and directional signage.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 961284, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
