ORDINANCE NO. 160362

 

Authorizing the Director of General Services to execute a Lease Agreement with Flying Truss, LLC for portions of the Kaw River Bridge, along with the accesses thereto, for a term of up to 54 years.

 

WHEREAS, on September 4, 1986, the Council passed Ordinance No. 59770 authorizing the City’s acquisition from St. Louis Southwestern Railway Company of certain of its railroad right-of-way on and near the site of Kemper Arena, which included a railroad bridge over the Kaw River (hereinafter “Kaw River Bridge”); and

WHEREAS, on November 3, 1988, the conveyance of that property to the City was completed by the Council’s passage of Ordinance No. 63235 in which the quit claim deeds conveying this railroad right-of-way and the Kaw River Bridge to the City were accepted; and

 

WHEREAS, the City continues to own this railroad right-of-way and the Kaw River Bridge; and

 

WHEREAS, that portion of the Kaw River Bridge on and above the bridge deck is not currently being used by the City for any purposes; and

 

WHEREAS, Flying Truss, LLC, is a Missouri limited liability company in good standing created and existing, according to its Articles of Organization, “[T]o acquire, design, construct and operate event spaces . . . .”; and

 

WHEREAS, Flying Truss, LLC, desires to lease those portions of the Kaw River Bridge which include the bridge deck, the bridge structure and space above the bridge deck and both the eastern and western accesses to the Kaw River Bridge to design, construct and operate an event space(s) on those portions of the Kaw River Bridge for an initial due diligence period of up to four (4) years, an initial term of twenty-five (25) years and an optional final term of twenty-five (25) years; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of General Services is authorized to execute a Lease Agreement with Flying Truss, LLC for those portions of the Kaw River Bridge which include the bridge deck, the bridge structure and space above the bridge deck and both the eastern and western accesses to the Kaw River Bridge for the design, construction and operation of an event space(s) on those portions of the Kaw River Bridge for an initial due diligence period of up to four (4) years, an initial term of twenty-five (25) years and an optional final term of twenty-five (25) years, in substantially the same form as that on file in the Office of the Director of General Services.
