ORDINANCE NO. 090420

 

Declaring an area of about 520 acres generally bounded by Blue Ridge Boulevard on the north, the Missouri Pacific Railroad on the south, the Big Blue River on the east and a line parallel to and 1/8 mile west of Wyandotte Street on the west, as a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Martin City Neighborhood Urban Renewal Plan. WHEREAS, the area bounded by Blue Ridge Boulevard on the north, the Missouri Pacific Railroad on the south, the Big Blue River on the east and a line parallel to and /18 mile west of Wyandotte Street on the west, is (1) blighted by reason of the predominance of defective or inadequate street layout, insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, retards the provision of housing accommodations or constitutes an economic or social liability or a menace to the public health, safety, morals, or welfare in its present condition or (2) insanitary by reason of a predominance of buildings and improvements which, by reason of dilapidation, deterioration, age or obsolescence, inadequate provision for ventilation, light, air sanitation or open spaces, high density of population and overcrowding of buildings, overcrowding of land, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, is conducive to ill health, transmission of disease, infant mortality, juvenile delinquency and crime or constitutes an economic or social liability and is detrimental to the public health, safety, morals, or welfare; and

 

WHEREAS, on April 22, 2008, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, adopted a resolution recommending that the area be declared blighted or insanitary and recommending approval of an Urban Renewal Plan for the area; and

 

WHEREAS, on April 7, 2009, the City Plan Commission reviewed this matter and recommended (1) approval of the designation of the area as blighted or insanitary area and (2) approval of the Urban Renewal Plan; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds that the proposed urban renewal area identified as the Martin City Neighborhood Urban Renewal Area generally bounded by Blue Ridge Boulevard on the north, the Missouri Pacific Railroad on the south, the Big Blue River on the east and a line parallel to and 1/8 mile west of Wyandotte Street on the west, and more specifically described as follows:

 

Beginning at the intersection of the west right of way line of Holmes Road and the south right of way line of E Blue Ridge Boulevard, both as now established, thence west along said south right of way line and the south right of way line of W Blue Ridge Boulevard as now established to the west right of way line of Wornall Road as now established, thence south along said west right of way line to the north line of Blue Hills Manor, a subdivision in Kansas City, Jackson County, Missouri, thence west along said north line to a point 8 feet east of the southeast corner of Lot 1, Clayton Budds Subdivision, a subdivision in Kansas City, Jackson County, Missouri, thence north along a line parallel to and 8 feet east of said Lot 1 to the south right of way line of W Blue Ridge Boulevard as now established, thence west along said south right of way line to the northwest corner of Lot 1, Helene E. Larsons Subdivision, a subdivision in Kansas City, Jackson County, Missouri, thence south along the west line of said Lot 1 and the west line of Lots 15 and 16, Blue Hills Manor to the southwest corner of said Lot 16, thence east along the south line of Lots 16 through 30, Blue Hills Manor to the west right of way line of Wornall Road as now established, thence south along said west right of way line to the north line of the Southwest 1/4 of the Northwest 1/4, Section 20, Township 47 North, Range 33 West, thence west along the north line of said 1/4 1/4 section to the west line of said Section 20, thence south along the west line of said Section 20 and the west line of Section 29, Township 47 North, Range 33 West to the northwest corner of the South of the Northwest 1/4 of said Section 29, thence South 21 degrees 05 minutes 15 seconds West 178.85 feet to a point on the north right of way line of the Missouri Pacific Railroad, thence northeasterly along said north right of way line to the south line of E. 135th Street as now established, thence east along said south right of way line to its intersection with the east right of way line of the Missouri Pacific Railroad, thence southwesterly along said east railroad right of way line to the most northwesterly corner of Lot 1, Sutherland Lumber Company, a subdivision in Kansas City, Jackson County, Missouri, thence generally south and east along the west and south lines of said Lot 1 to the west right of way line of Holmes Road as now established, thence south along said west right of way line to the south right of way line of E 137th Street as now established, thence west along said south right of way line to the northwest corner of Lot 1, Martin City Safety Storage, a subdivision in Kansas City, Jackson County, Missouri, thence generally south and east along the west and south lines of said Lot 1 to the west right of way line of Holmes Road as now established, thence north along said west right of way line of Holmes Road to its intersection with the westerly prolongation of the south line of Lot 6, Emrichs Addition, a subdivision in Kansas City, Jackson County, Missouri, thence easterly along said westerly prolongation and the south line of said Lot 6 to the southeast corner of said Lot 6, thence north along the east line of Lots 3 through 6 of said Emrichs Addition to the southeast corner of Lot 2, Emrichs Addition, thence east along the easterly prolongation of the south line of said Lot 2 to a point 450 feet west of the east line of Section 20, Township 47 North, Range 33 West as measured perpendicular to said east line, thence north along a line parallel to and 450 feet west of the east line of said Section 20 to the south line of the northeast 1/4 of said Section 20, thence northeasterly along a line to the northeast corner of the south 30 acres of the Southeast 1/4 of the Northeast 1/4 of said Section 20, thence north along the east line of said Section 20 to the northeast corner of the Southeast 1/4 of the Northeast of said Section 20, thence west 396.835 feet along the north line of the Southeast 1/4 of the Northeast 1/4 of said Section 20 to the southwest corner of the east 12 acres of the Northeast 1/4 of the Northeast 1/4 of said Section 20, thence north along a line parallel to and 396.835 feet west of the east line of said Section 20 to the south right of way line of E Blue Ridge Boulevard as now established, thence west along said south right of way line to the point of beginning.

 

is a blighted or insanitary area in need of redevelopment or in need of rehabilitation and is appropriate for an urban renewal project by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, pursuant to Chapter 99, RSMo.

 

Section 2. That the Council finds that the Urban Renewal Plan is feasible and in conformity with the general plan for the development of the community as a whole.

 

Section 3. That the Martin City Neighborhood Urban Renewal Plan, a copy of which is on file in the office of the City Clerk with this ordinance and is hereby approved.
