Approving an amendment to a previously approved
development plan in District PD/RA (Agricultural/Planned District) on
approximately a 42 acre tract of land generally located on the east side of
N.W. Waukomis Drive, approximately one-quarter mile south of N.W. 64th Street,
for the purpose of deleting an approximately 11.58 acre tract of land from said
development plan. (11777-PD-4)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved development plan in District PD/RA (Agricultural/Planned
District) on approximately a 42 acre tract of land generally located on the
east side of N.W. Waukomis Drive, approximately one-quarter mile south of N.W.
64th Street, and more specifically described as follows:
Part of the North Half
of the Northeast Quarter of Section 28, Township 51, Range 33, Platte County,
Missouri, described as follows: Beginning at a point on the east line of said
Quarter Section, said point being 330 feet south of the northeast corner of
said Quarter Section; thence west, 330 feet south of and parallel with the
north line of said Quarter Section, a distance of 1381.50 feet; thence
deflecting 9119'18" to the left, a distance of 264.44 feet; thence
deflecting 9227'18" to the right, a distance of 162 feet; thence
deflecting 2743' to the right, a distance of 145.65 feet; thence deflecting
6305' to the right, a distance of 91.0 feet; thence westerly in a straight
line to a point on the easterly line of the right of way of the Old Kansas City
St. Joseph Electric line, now used as a state highway, said point being 107.00
feet southerly of a line 330 feet south of and parallel with the north line of
said Quarter Section as measured along said right of way line; thence
southeasterly along said right of way line, a distance of 935.5 feet to a point
on the south line of the North Half of the Northeast Quarter of said Section
28; thence easterly along the south line of the North Half of the Northeast Quarter
of said Section 28, a distance of 1766.60 feet to the southeast corner of the
North Half of the Northeast Quarter of said Section 28, thence northerly along
the east line of the Northeast Quarter of said Section 28, a distance of 990
feet to the point of beginning. Containing 41.743 acres, more or less.
for the purpose of deleting therefrom an
approximately 11.58 acre tract of land, more specifically described as follows:
All that part of the
North Half of the Northeast Quarter of Section 28, Township 51, Range 33,
Kansas City, Platte County, Missouri, described as follows: Commencing at the
northeast corner of the Northeast Quarter of said Section 28; thence South
0031'02" West along the east line of the Northeast Quarter of said
Section 28, also being the east line of North K.C. Addition, a subdivision of
land in the City of Kansas City, Platte County, Missouri, also being the west
line of Clayton Meadows Second Plat, a subdivision of land in the City of
Kansas City, Platte County, Missouri, a distance of 330.00 feet to the
southeast corner of said North K.C. Addition, said point being the point of
beginning of the tract of land herein to be described: thence North 8932'51"
West, along the south line of said North K.C. Addition, a distance of 193.20
feet; thence South 3934'51" West, a distance of 484.73 feet; thence South
2215'02" West, a distance of 650.00 feet to a point on the north line of
Clayton Meadows West, a subdivision of land in the City of Kansas City, Platte
County, Missouri; thence South 8920'58" East along the south line of the
North Half of the Northeast Quarter of said Section 28 also being the north
line of Clayton Meadows West, a distance of 739.36 feet to the southeast corner
of the North Half of the Northeast Quarter of said Section 28, also being the
northeast corner of Lot 7 of said Clayton Meadows West; thence North
0031'02" East along the east line of the Northeast Quarter of said
Section 28, also being the west line of Clayton Meadows First Plat, a
subdivision of land in the City of Kansas City, Platte County, Missouri, and
the west line of said Clayton Meadows Second Plat, a distance of 982.11 feet to
the point of beginning. Said tract of land contains 11.58 acres, more or less.
so that the remaining tract of land of
approximately 29.65 acres, more specifically described as follows:
All that part of the
Northeast Quarter of Section 28, Township 51, Range 33, in the City of Kansas
City, Platte County, Missouri, described as follows: Commencing at the
northeast corner of the Northeast Quarter of said Section 28; thence South
0031'02" West, along the east line of the Northeast Quarter of said
Section 28, a distance of 330.00 feet; thence North 8932'51" West, a
distance of 193.20 feet to the point of beginning of the tract of land herein
to be described; thence South 3934'51" West, a distance of 484.73 feet;
thence South 2215'02" West, a distance of 650.00 feet to the south line
of the North Half of the Northeast Quarter of said Section 28; thence North
8920'58" West, along said line a distance of 1027.48 feet to the easterly
right of way of N.W. Waukomis Drive; thence North 2026'53" West along
said right of way, a distance of 937.74 feet; thence South 8932'51" East,
a distance of 440.59 feet; thence South 0223'09" West, a distance of
90.98 feet; thence South 6041'51" East, a distance of 145.65 feet; thence
South 8824'51" East, a distance of 162.00 feet; thence North 0052'08"
West, a distance of 264.44 feet; thence South 8932'51" East, a distance
of 1188.30 feet to the point of beginning. Said tract contains 29.65 acres,
more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any necessary
improvements as required by the City Engineers Office.
3. That
the developer install hard surface roads adequate to support fire trucks and
equipment as required by the Fire Department.
4. That
the developer dedicate additional right of way for Line Creek Parkway as
required by the Department of Public Works so as to provide a total of 100 feet
of right of way as measured from the centerline of Line Creek Parkway and 50
feet of right of way for the ATA rapid transit corridor as measured from the
right of way line for Line Creek Parkway.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer obtain a floodplain certificate from the Department of Codes
Administration prior to beginning any construction activities within the
floodplain.
7. That
the developer show the limits of the floodplain on the final plat.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 990618, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
