ORDINANCE NO. 090769

 

Declaring an area of about 103 acres generally bounded by E. 42nd Street on the north, Emmanuel Cleaver II Boulevard on the south, The Paseo on the east and a line midway between Troost Avenue and Harrison Boulevard on the west, as a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Troost Paseo Urban Renewal Plan. (676-S)

 

WHEREAS, the area bounded by E. 42nd Street on the north, Emmanuel Cleaver II Boulevard on the south, The Paseo on the east and a line midway between Troost Avenue and Harrison Boulevard on the west, is (1) blighted by reason of the predominance of defective or inadequate street layout, insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, retards the provision of housing accommodations or constitutes an economic or social liability or a menace to the public health, safety, morals, or welfare in its present condition or (2) insanitary by reason of a predominance of buildings and improvements which, by reason of dilapidation, deterioration, age or obsolescence, inadequate provision for ventilation, light, air sanitation or open spaces, high density of population and overcrowding of buildings, overcrowding of land, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, is conducive to ill health, transmission of disease, infant mortality, juvenile delinquency and crime or constitutes an economic or social liability and is detrimental to the public health, safety, morals, or welfare; and

 

WHEREAS, on July 29, 2009, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, adopted a resolution recommending that the area be declared blighted or insanitary and recommending approval of the Troost Paseo Urban Renewal Plan (Urban Renewal Plan) for the area; and

 

WHEREAS, on July 7, 2009, the City Plan Commission reviewed this matter and recommended (1) approval of the designation of the area as blighted or insanitary area and (2) approval of the Urban Renewal Plan; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds that the proposed urban renewal area identified as the Troost Paseo Urban Renewal Area generally bounded by E. 42nd Street on the north, Emmanuel Cleaver II Boulevard on the south, The Paseo on the east and a line midway between Troost Avenue and Harrison Boulevard on the west, except the following properties:

 

A tract described as follows: Beginning at the point of intersection of the centerlines of East 42nd Street and The Paseo; thence generally southerly along the centerline of The Paseo to the point of intersection of the centerlines of The Paseo and Emanuel Cleaver II Boulevard; thence generally westerly along the centerline of Emanuel Cleaver II Blvd to the point of intersection of the centerlines of Troost Avenue and Emanuel Cleaver II Boulevard; thence northerly along the centerline of Troost Avenue to the intersection of the centerline of Troost Avenue and the north right-of-way line of Brush Creek Boulevard; thence westerly along the north right-of-way line of Brush Creek Boulevard to a point half way between Troost Avenue and Harrison Street; thence northerly from such half way point to the centerline of East 42nd Street, specifically including the following lots that abut the western right-of-way line of Troost Avenue - Lots 1 through 11 inclusive, Block 1, Lansdowne Addition, Lots 1 through 12 inclusive, and the vacated triangular tract adjacent to said Lot 12 at the southeast corner thereof, Block 8, Sunny Slope, Lots 1 through 12 inclusive, Block 1, SUNNY SLOPE, Tracts 1 and 2 of the Certificate of Survey of Lots 11 and 12, Resurvey of Block 7, Troost Highlands, filed as Document No. K520840, Book S-1, Page 158, on May 3, 1982, Lots 3 through 10 inclusive, Resurvey of Block 7, Troost Highlands, and Lot A, Corbins 2nd Resurvey; thence generally easterly along the centerline of East 42nd Street to the Point of Beginning, all situated in the City of Kansas City, Jackson County, Missouri, except excluding the following lots:

Lots 9 through 13 inclusive and the South 58.2 feet of Lot 14, Block 2, Corrected Plat of Wightman & Sears, 2nd Addition.

 

is a blighted or insanitary area in need of redevelopment or in need of rehabilitation and is appropriate for an urban renewal project by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, pursuant to Chapter 99, RSMo.

 

Section 2. That the Council finds that the Urban Renewal Plan is feasible and in conformity with the general plan for the development of the community as a whole.

 

Section 3. That the Troost Paseo Urban Renewal Plan, a copy of which is on file in the office of the City Clerk with this ordinance and is hereby approved.
