COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140944

 

Approving an amendment to a previously approved Chapter 80 preliminary plan in Districts M-2a-p/US (Heavy Industry - Limited District/Underground Space), on approximately 1,128 acres generally bounded by Missouri Highway 210 on the south, the city limits of Claycomo, Liberty and Birmingham on the north and east, and a line approximately 500 feet west of N. Kentucky Avenue on the west, to delete about 417 acres from the existing Chapter 80 approved development plan. (10694-P-25)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in Districts M-2a-p/US (Heavy Industry - Limited District/Underground Space), on approximately 1,128 acres generally bounded by Missouri Highway 210 on the south, the city limits of Claycomo, Liberty and Birmingham on the north and east, and a line approximately 500 feet west of N. Kentucky Avenue on the west, and more specifically described as follows:

 

Part of Sections 1, 2 and 11, Township 50, Range 32, and all that part of Section 35 and 36, Township 51, Range 32, including all or part of Lindeman Addition, Phister Place and Hiltons Addition, all being in Kansas City, Clay County, Missouri, lying above the top of the Winterset Ledge of Limestone Rock, being more particularly described as follows: Beginning at the northwest corner of said Section 2, said point being also the southwest corner of said Section 35; thence South 0 degrees 37 minutes 24 seconds West, along the west line of the Northwest Quarter of said Section 2, 2592.06 feet; thence South 60 degrees 10 minutes 49 seconds West, 551.05 feet; thence South 29 degrees 49 minutes 11 seconds East, 716.97 feet; Except that part conveyed by Document No. E-66951, in Book 1523 at page 75, and except that part condemned by Wabash Railroad Company in Case No. 27694 in the Circuit Court of Clay County, Missouri, a certified copy of the Commissioners Report being filed as Document No. B-45434 and of record in Book 720 at page 224 in said Recorders Office. Containing a net area of 1127.89 acres, more or less.

 

which will delete about 417 acres, is hereby approved, subject to the following conditions:

 

1.                  That four (4) collated, stapled and folded copies (and a CD containing a pdf file, a georeferenced monochromatic TIF file, and CAD/GIS compatible layer of the site plan boundary referenced to the Missouri state plan coordinate system) of (a revised drawing /all listed sheets), be submitted to Development Management staff, prior to issuance of building permit.

 

2.                  Conditions of Ordinance No. 020317, passed by City Council on April 11, 2002, still apply to the remainder of the development plan (Case No. 10694-P-25).

 

3.                  That the following unbuilt improvements be constructed, if warranted, as required by previously approved Parvin Road Traffic Impact Study:    

 

·                     Traffic signal at N.E. Great Midwest Drive and Missouri Highway 210 intersection;

·                     Traffic signal at N.E. Parvin Road and N. Randolph Road intersection;

·                     Traffic signal at N.E. Parvin Road and N.E. Great Midwest Drive intersection;

·                     Traffic signal at N.E. Parvin Road and N. Skiles Avenue intersection;

·                     Traffic signal at N.E. Parvin Road and N. Corrington Avenue intersection;

·                     Traffic signal at N.E. Parvin Road and N. Kentucky Avenue intersection; and

·                     Westbound left turn lane at N.E. Parvin Road and N. Randolph Road intersection.

 

4.                  That all striping, signage, and signalization recommendations shall be consistent with the recommendations in the Manual on Uniform Traffic Control Devices, the design standards and specifications of the City of Kansas City, Missouri and the Missouri Department of Transportation, and any other applicable design standards or specifications.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
